To answer the question on what makes a good leader appropriate, it is important to acknowledge that traditional qualities that have defined a good leader such as aptitude, strength, determination, and vision are not sufficient in today’s world. In this changing world, a leader- in addition to the listed qualities- needs a high degree of emotional intelligence.

A look at history can reveal a number of highly skilled and intelligent leaders who took over leadership of their country only for them to perform dismally. There are various aspects of emotional intelligence that are critical to good leadership. According to Goleman, “they include self-awareness, enthusiasm and responsiveness. Others include group skills and self-regulation” (21). Researchers have carried out studies in the corporate world, and the results have shown that emotional intelligence is often what distinguishes the outstanding leader.

The first component I analyze is the aspect of self-awareness. This refers to the ability to have a deep understanding of one’s emotions, strengths, weaknesses, motivational factors. To be self aware means that one is honest with his or herself. It also implies that the individual is neither critical of others nor unrealistic.

Further, individuals who are self aware can predict how different emotions will affect them and the performance of their work. For example, a leader who has self awareness may know that interviews with the press often make him or her nervous. Therefore, it is prudent to avoid such interviews and choose other methods of communication.

The same self awareness can be applied when it comes to ideals and values in which an individual believes. It has often been said that a leader who does not believe in anything will fall for anything. Therefore, the leader with self-awareness will be able to turn down an investor’s request to set up a big industry in the country if that investment will hurt the environment.

Weak leaders who lack self awareness will accept to do something, but after two or three years down the line, they will rescind their decision. It can be noted that people who have self awareness are coherent and articulate. They are able to speak openly and precisely tackle the areas they are addressing. They are also able to describe themselves accurately (Northouse 154).

The other component of emotional intelligence is self regulation. From the onset, it is important to acknowledge that emotions are part human life. Although humans cannot do away with emotions, it is possible to control and manage them.

Self regulation is the ability to manage and control one’s feelings in order to make one free from distractions. In this case, individuals should also be able to direct these feelings to a useful channel. For example, a leader may witness a shambolic presentation by members of his cabinet to a key investor.

With the disappointment, the leader may feel the urge to kick a chair or bang the table which will bring a negative side of him to the investors. Therefore, self-regulation is the ability to apologize to the investor and carefully select the words that will authoritatively, yet humbly explain to the members of the cabinet the areas that will need to be corrected. Another example is when the leader of a country faces a threat of attack from another country.

In such a delicate matter, one wrong move can cost the country in many ways. However, if the leader maintains calmness, does not panic, and can prepare the relevant stakeholders to deal with the problem, then the effect is different, and the damage can be controlled.

Self-regulation is also a strong pillar of integrity. Thornton noted, “on many occasions, people with integrity are often caught in decisions that lack integrity” (p.13). Although such leaders have integrity, they lack self-regulation, which often enhances integrity. An example is a leader who is faced with a crisis and has no solution for the crisis.

In the heat of things, the leaders may decide to apply a solution that is outside the law. Thus, although the action may have been intended to help the country, lack of self regulation may lead the leader to undermine his own integrity. The third aspect of emotional intelligence is motivation. It is almost an unwritten rule that a good leader should have motivation. In this context, motivation refers to the urge to achieve.

A motivated leader is one who is never contented with the status quo. They are always striving to do better things and doing them differently. Such leaders often raise the performance bar, and they keep track of the scores. In this case, a good example is Thomas Sankara, the slain leader of Burkina Faso from Africa. Sankara became the leader of Burkina Faso at a time when the country was reliant on donor funds.

Uncomfortable, with the status quo, he led his countrymen on an overdrive to practice farming to a level that had hitherto been unseen. The country was for the first time able to feed all its population without the aid from foreign countries. The same leader introduced a government policy requiring all top government officials to stop the usage of the extravagant Mercedes Benzes. Instead, government officials were encouraged to use the modest Volkswagen vehicles so as to save money for increment of teacher’s salaries.

The fourth component of emotional integrity is empathy. The uniqueness of this component is that, unlike the aforementioned components, this component is very easy to identify and recognize. However, the modern world will rarely reward a leader in business or politics on account of empathy. In this case, the conventional understanding of empathy is to be able to take other peoples’ feelings and give them priority as if they were one’s own.

In this context, empathy refers to the ability of the leader to consider the interests of all stakeholders when making decisions. The last component is the idea of social skills. The two components are related as they are concerned with the ability to establish meaningful relationships with other people. A leader is always leading and managing people. Thus, a good leader should be able to get along with these people.

From the discussion, it is clear that, to lead a country, a great team is what will deliver great leadership. However, in every country, there is a leader. Some are led by a monarch, others by dictators, or others like the United States by a democratically elected leader. A Clear-Eyed Look at the Early Obama Years

Vinson Cunningham’s new novel takes the reader back to a time when many thought the nation’s first Black president had an answer for every American ailment.

Like so many others, I first watched him speak on the night of the 2004 Democratic convention, the year John Kerry became the nominee. He was still a state senator then, his face unlined, his head full of dark-brown hair. He humbly told the audience that his presence there was “pretty unlikely.” His Kenyan father had grown up herding goats; his paternal grandfather cooked for a British soldier. In a Baptist cadence, he quoted from the Declaration of Independence. Jefferson’s words are stirring on their own, but when a certain kind of orator gets hold of them, the effect can feel like thunder, or the Spirit. The country had tumbled into a new century after a contested election and the start of a war in Iraq. Barack Obama spun a convincing vision of the nation as “one people,” in which our ethnic, religious, and ideological differences mattered little.

When I think about what Obama meant to me at the time, my eyes pool with water. I was fresh out of college, taken by the force of his intellect and the way his ideas seemed to cohere and hum. His ear for language was evident in his oratory and in his prose. Dreams From My Father , his first memoir, drew from a humanist tradition of American autobiography laid down by Frederick Douglass, Harriet Jacobs, Malcolm X, and James Baldwin. Toni Morrison’s eulogy of Baldwin in 1987 seemed to foreshadow what many would feel about Obama in 2008: “You made American English honest … You exposed its secrets and reshaped it until it was truly modern dialogic, representative, humane.”

And yet, it wasn’t enough; the reverie wouldn’t, couldn’t last. In Great Expectations , Vinson Cunningham’s debut novel, the New Yorker writer and critic assesses the hope and disillusionment of the Obama years in a thinly veiled political satire cum bildungsroman featuring an Obama-like junior senator as “the candidate,” as well as a multifarious cast of supporting characters who employ their savvy, money, and connections to get him elected as president. Cunningham takes the reader back to a time when many thought Obama had an answer for every American ailment: He would usher the country into a post-race era, offering white people grace and absolution while assuring Black people that they would hereafter get a fair shake.

The novel is a keen look back at the failed promise of those early years, during which the country’s lofty expectations left little room for the candidate’s human fallibility—and obscured the reality of American politics. In this country, progress has usually happened in complicated, nonlinear ways: Hard-won advances are generally followed by forceful backlash and heartbreaking setbacks. Advances in civil rights, economic equality, health-care access, or environmental policy have often triggered reactionary codas; since at least the end of Reconstruction, momentum toward multiracial democracy has inflamed particularly vitriolic responses. Ultimately, Cunningham’s novel reminds the reader that simple solutions—the passage of one just law, the election of a single great leader—are seldom a match for American problems.

The narrator—based on the author himself, who worked on Obama’s 2008 campaign and in his White House—is David Hammond, a 22-year-old single father from uptown Manhattan. Floundering after dropping out of college, he joins the campaign as a fundraising assistant on the recommendation of the well-heeled mother of a teen boy he tutors. As the novel roves from Manhattan to Manchester, New Hampshire; from Los Angeles to Chicago, David, whose true ambition is to be a writer, uses his new role to sharpen his ear and eye. He’s middling at the minutiae of the job but great at interacting with people. He makes friends with his co-workers and stumbles into a tender love affair with another staffer named Regina. Along the way, he loses slivers of his innocence as he sees what lies beneath the campaign’s shimmering exterior: the candidate’s aloofness when he is offstage, the financial improprieties of a few wealthy patrons. Eventually, the blind allegiance of the candidate’s supporters—their belief that the campaign is a “move of God”—begins to feel foreboding.

David often invokes the ecstatic mysticism of religious devotion as a metaphor for the candidate’s hold on his supporters. The senator “reminded me of my pastor,” David says early on, his regal posture bringing to mind a “talismanic maneuver meant to send forth subliminal messages about confidence and power.” One night, on the trail in New Hampshire, David tells Regina about a magic trick he witnessed as a teenager: While waiting outside of church with his friends, he watched as a magician performed a standard sleight of hand, then levitated a few inches off the city pavement. “Everybody screamed. It was mayhem,” David remembers. “Black people love magic,” Regina rejoins, through laughter. It is a detour in a novel of detours and roundabouts, and also a parable that smartly explains how the candidate’s fervent admirers could be so awed by his charisma that they missed the signs of trouble to come.

Sometimes David allows himself to get carried away like everyone else. He thinks about how the candidate and his family had begun to embody some kind of national fantasy of a Black Camelot. “Maybe there was the hope that black , that portentous designation, could finally be subsumed into the mainstream in the way that Kennedy had helped Irish to be. That some long passage of travel was almost done,” he thinks at one point. In that same stream of thought, David suggests that the public’s belief in the candidate’s ability to dismantle the racial hierarchy is largely thanks to his symbolic appeal: It was, he observes, “mostly the look” of the candidate and his glamorous family—an elegant wife and two small daughters—that made supporters believe he could overcome racism. Who wouldn’t want to accept them ?

Privy to the campaign’s disappointments and its weaknesses, David is clear-eyed where others are credulous. With the benefit of hindsight, the reader knows that his skepticism would eventually be validated. In the years since Obama’s election, America has seen the birtherism movement, the rise of the Tea Party, Donald Trump’s presidency, and the dismantling of cornerstone civil-rights victories, including key portions of the Voting Rights Act. Then, of course, there were Obama’s own shortcomings during his presidency, namely his capitulation to forces opposed to his most idealistic visions. He would pass a new health-care bill, but fall short of the goal of universal coverage he campaigned on . He would withdraw troops from Afghanistan but begin a series of what the political scientist Michael J. Boyle called “ shadow wars ,” which were “fought by Special Forces, proxy armies, drones, and other covert means.” According to the Council on Foreign Relations , drone strikes authorized by President Obama led to the deaths of nearly 4,000 people in Pakistan, Yemen, and Somalia; more than 300 of them were civilians.

When Cunningham’s novel closes on that fateful night in November, the night of the candidate’s victory, it’s an ending for David, a graduation, even. The book implies that he will go on to work for the new president, but unlike everyone else in that ecstatic moment, he looks to the coming years soberly, acknowledging that the campaign had spoken “a language of signs,” wherein the symbolism of the moment overwhelmed all else. Already, he seems to know that the country will see no grand, lasting transformation. For many Americans, who felt on a similar, actual night that the world seemed on the precipice of change, the lessons would take much longer to learn.

The Eclipse Is Great for Learning. But It’s Tough on School Logistics

A total solar eclipse will cross a large swath of the country on April 8, sparking tough management choices for leaders of the school districts in its path.

The rare astronomical event will provide an engaging science activity for students. But in many districts, concerns about traffic, crowds, and safety have eclipsed the potential upsides of the collective learning event, sparking precautionary school closures and early student releases.

“I’m a former science teacher, so this is right up my alley,” said Paul Norton, superintendent of the Lake Travis district in Austin, Texas, which will close that day. “We want to make sure our kids are aware of why this is a generational opportunity, but we also don’t want our buses to be stuck on the road [returning students home] until 7 o’clock at night.”

In an event dubbed “the Great North American Solar Eclipse,” the moon will pass between the sun and the Earth, blocking out daylight for people in a 115-mile-wide path of totality that will stretch from Texas to Maine, starting at about 1:40 Central Time, NASA projects.

The total solar eclipse—the last that will be visible in the contiguous United States until 2044—will give viewers the rare opportunity to see the sun’s outer atmosphere, known as a corona, which is usually obscured by the star’s bright light. The temperature will drop in the eclipse’s path, nocturnal animals may stir, and many viewers will see a 360-degree sunset effect.

It will all be over in less than four minutes, scientists project, but educators recognize the eclipse could fuel weeks of classroom discussions and potentially spark a long-term interest in science for students who see it.

Lake Travis district leaders started preparing for the eclipse last summer, Norton said. Ultimately, a recommendation from the county’s emergency management department led leaders to close schools that day.

Communities across the path of totality expect an influx of tourists and accompanying traffic that could make it difficult for students to walk or ride home in a safe, timely manner, superintendents said. Lake Travis is surrounded by wineries and public lands that will host large events for the eclipse, which will bring out-of-towners—many in RVs—to the region.

Educators plan to teach lessons on the eclipse in advance so that students are prepared to view it at home, Norton said.

Like Lake Travis, hundreds of school systems across the country plan to close that day, some in anticipation of high numbers of absences from students who plan to take a day off to view the eclipse with their families. Some have opted for early dismissals or e-learning days with planned breaks for students to step outside. Further north, the eclipse is expected to hit right around school dismissal times, creating driving challenges for new teen drivers.

Educators are also concerned about monitoring young students during the darkness and ensuring they all wear special disposable glasses that make it safe to view the eclipse. Even just a few moments observing without proper protective eyewear can permanently damage the eye’s retina, scientists and doctors warn.

“This truly is a once-in-a-lifetime event, and we are fortunate to be in the middle of the action,” said a notice from the Cleveland Metropolitan School District, which plans to close April 8.

The district will provide donated glasses to each of its students for home viewing, and its website links to information about watch parties hosted by the city’s library and several museums.

Eclipse provides science learning opportunities

In Arkansas, where the eclipse will cross the state in a diagonal path, students will have a special opportunity to learn collaboratively with their peers in other districts, even if their schools are closed, state education Secretary Jacob Oliva said.

Sixty schools in 45 counties have signed up for a special data collection project in cooperation with the state’s K-12 computer science initiative, through which students and teachers will use special handheld sensors to collect data about shifts in light and temperature levels as the moon passes in front of the sun.

Researchers at the University of Central Arkansas, who trained teachers to use the devices through regional education service cooperatives in recent months, will then combine the data. Following the event, students across the state can then use the results for data-analysis projects in science and computer science classes.

Eclipse FAQs for Educators

Is it safe for students to view the eclipse.

Except for a brief moment of total sun coverage, it is not safe to view the eclipse with the naked eye, NASA scientists caution. But students can safely view it through special eclipse glasses or by projecting the sun’s outline onto the ground through simple homemade devices. Read more here.

“We need to embrace this as a full educational experience,” Oliva said. “Any time we can support teachers and leaders to bring relevance to the classroom, it’s a real win for everybody.”

More than Arkansas 130 school districts and charter schools have announced plans to close that day. In anticipation, the state has provided resources for students as young as prekindergarten to learn about the solar system, make art projects inspired by the eclipse, and craft devices like cardboard pinhole viewers that project the sun’s outline on the ground for safe viewing.

At the Arkansas School for the Blind, students will use special handheld LightSound devices created by researchers at Harvard University that project a sound that changes in pitch as an internal sensor detects less light.

“It is really a positive thing to hear so much excitement around science,” Oliva said.

Staying open, staying safe

Some districts have opted to stay open the day of the eclipse, preparing educators in advance to help their students safely view it.

In Ann Arbor, Mich., where the eclipse will occur at about 3:13 p.m., district leaders used donations from businesses to buy 20,000 pairs of eclipse viewing glasses—enough for all 17,000 students plus teachers, administrators, and bus drivers who want to take in the event, said Tony Stamm, the district’s elementary math and science curriculum coordinator.

“We won’t see this event again here until 2099,” Stamm said. “To actually be able to step outside and witness something like this during the day together, that’s really rare. I don’t think there’s anything comparable that really accounts to the magnitude of the event, as well as the accessibility.”

The district has its own planetarium, a rare facility for K-12 schools, but teachers don’t often have the opportunity to explain the movement of planets and stars in such a real-world fashion, Stamm said. The district created lesson plans for elementary school teachers, including special materials for those in grades that don’t typically include units on space, he said. Administrators also drafted special announcements for principals to read over school intercoms, including safety instructions and advice for viewing.

At Ann Arbor’s middle schools, the eclipse is expected to darken the sky right at dismissal time. Rather than cancel classes, educators have planned a community event, inviting families to picnic outside with their students and learn about science together.

“We are trying to cover it from all areas because we know this is a unique opportunity that won’t happen again in many of our lifetimes,” Stamm said.

Why wouldn't you stand for the Pledge of Allegiance? Parents, teach kids patriotic values.

Parents, you hold the keys only you can enforce homework, bedtime, use of technology and other disciplines that will make your kids the people you hope them to be..

In public schools across the country, students are not required to stand for the Pledge of Allegiance . (Private schools are different.) Courts have ruled that students in public schools may exercise their right to “silent speech.”

Teachers across Oklahoma are not allowed to force, persuade or recommend students to participate in the pledge, the national anthem and certainly not prayer (allegedly per administrators) for fears of lawsuits.

I was fortunate to have the trust of my students, such that I could ask them to share their viewpoints. I asked why they didn’t stand for the pledge. The top two answers made up 80% of the answers:

  • No one else stands, so why should I?
  • It’s not that important to our generation.

There was a third answer, which shook me to the core.

'They hate me,' says student of color

One of the sweetest and smartest girls said this: "They hate me.” I should tell you that she was of color.

Later, I had a private discussion with that student and asked if she would elaborate on her answer. She shared that she believed that the country was run by an establishment that simply hated her.

What do you say when someone says something so poignantly painful? The last thing I was in the position to do was to question, deny or debate how she felt.

All I could tell her was that I didn’t hate her, and that if anyone did indeed hate her, then they were either bad people or idiots.

I believe that most of society, especially in Oklahoma, is made up of good people.

However, we have made love and empathy two sides of the same coin. We are capable of love, but we seem to struggle with empathy. Sadly, it seems that today’s political division has made problems worse.

America will stay great because of other Americans

Love is a two-way street.

Why we don’t exemplify to our future leaders the simple truth that an American’s greatest ally will always be another American is a shame because that is how America will stay great!

I quit my job as a teacher after 20 years. Schools are stealing our autonomy.

My parents immigrated to the United States in 1960. One of the best days of my late father’s life was when he, my mother and older brother became citizens of the country that we love. When his grandson (my nephew) graduated from the U.S. Naval Academy, Dad was in tears.

If I hadn’t stood for the pledge, my father would have done something about it.

Parents should model patriotic behavior

This leads me to my universal conclusion. Parents, you hold the keys! Not only are you responsible for providing love, security, shelter and nutrition, but you are in the best position (legally and morally) to instill the virtues of education, patriotism, hard work and family onto our kids. Only you can enforce homework, bedtime, use of technology and other disciplines that will make your kids the people you hope them to be.

Finally, I want to honor retired Col. Greg Barrack, who passed away recently. Col. Barrack oversaw the Junior ROTC program at my school. His classroom was a sanctuary where teachers and students could freely discuss the importance of patriotism. Why administrators would not allow that privilege to all corners of the school is debatable, because I’m pretty sure that no jury in the state of Oklahoma would ever give financial rewards to kids for the pain and suffering of standing at attention for our country.

Something Other Than Originalism Explains This Supreme Court

It is a sign of the polarizing nature of the current Supreme Court that even knowledgeable critics of its opinions make diametrically opposed arguments.

This week, for example, the former Supreme Court justice Stephen Breyer, in a new book, “Reading the Constitution,” chides the current court’s approach to the law, which he says fixates on the text of the Constitution and attaches too much significance to the meanings of its provisions at the time they were ratified. If only, Justice Breyer urges, justices would soften this “originalist” approach and take into account how “our values as a society evolve over time” — including by respecting the “longstanding practice” of the court and other organs of government.

Justice Breyer’s criticism follows on the heels of that of another judge, Kevin Newsom of the U.S. Court of Appeals for the 11th Circuit. In a talk last month at Harvard Law School, Judge Newsom made the opposite argument: He criticized the Supreme Court, when considering matters such as handgun regulation and abortion rights, for being insufficiently faithful to originalism and overly attuned to social practices that occurred or continued after constitutional ratification. Such traditions, he warned, “have no demonstrable connection to the original, written text.”

The current Supreme Court is the object of considerable controversy and confusion. To understand its decisions properly, especially over the past three or four years, the key is to realize that each critic is half right. Justice Breyer is right that the Constitution should be interpreted, in part, in light of practices that persisted after its ratification, but wrong to think that the current court is not doing this. Judge Newsom is right that the current court is doing this, but wrong to think that it should not be.

This court is conventionally thought of as originalist. But it is often more usefully and accurately understood as what I call “ traditionalist ”: In areas of jurisprudence as various as abortion, gun rights, free speech, religious freedom and the right to confront witnesses at trial, the court — led in this respect by Justices Samuel Alito, Clarence Thomas and Brett Kavanaugh — has indicated time and again that the meaning and law of the Constitution is often to be determined as much by enduring political and cultural practices as by the original meaning of its words.

The fact that the Supreme Court seems to be finding its way toward an open embrace of traditionalism should be broadly celebrated. To be sure, the court’s traditionalism has played a role in many decisions that have been popular with political conservatives, such as the Dobbs ruling in 2022 that overturned Roe v. Wade. But it is not a crudely partisan method. Justice Sonia Sotomayor, an Obama nominee, has used it in a decision for the court — and Justice Amy Coney Barrett, a Trump nominee, has expressed some skepticism about it.

Traditionalism may not be partisan, but it is political: It reflects a belief — one with no obvious party valence — that our government should strive to understand and foster the common life of most Americans. The Supreme Court has relied on traditionalism to good effect for many decades, though the justices have seldom explicitly acknowledged this. Traditionalism should be favored by all who believe that our legal system ought to be democratically responsive, concretely minded (rather than abstractly minded) and respectful of the shared values of Americans over time and throughout the country.

To get a better sense of what traditionalism is, it is useful to compare it with the two dominant approaches to constitutional interpretation in adjudication: originalism and what is often called “living constitutionalism.”

Sometimes the Constitution’s words are not clear and their application to a particular issue is also unclear. Consider the line “Congress shall make no law respecting an establishment of religion,” from the First Amendment. Judges face choices about how to determine what exactly Congress (and today, by extension, the states) is being forbidden from doing.

One option is to discern the meaning that those words would have had at the time of their adoption, using ratification-era dictionaries, contemporary documents by learned authorities, databases of usage, other linguistic and legal sources and perhaps activities closely confined to the founding period. That is originalism.

Another option is to understand those words by recourse to a high ideal or abstraction. For example, a judge might take that passage of the First Amendment to reflect a principle of separation of church and state and then apply that principle in light of the judge’s moral views or perceptions of contemporary moral standards in the case at hand. That is living constitutionalism.

Traditionalism offers a third option. Here, one would look at specific political and cultural practices — the activities of the organs of government and of individuals and groups across the country over long periods of time — to help determine constitutional meaning and law. For example, one might observe that the practice of legislative prayer (prayer that opens legislative assemblies) was pervasive long before and at the time of the First Amendment’s ratification, and that it continued for centuries afterward. For that reason, one would conclude that legislative prayer is unlikely to violate the prohibition against an “establishment of religion.”

The intuition is straightforward: It would be odd to think that the Establishment Clause of the First Amendment prohibits legislative prayer if legislative prayer was widely practiced before, during and for centuries after ratification. Were we supposed to put a stop to a practice many showed no sign of wanting to stop, and indeed, that a great many people were eager to continue and did continue? Sometimes, yes, moral reflection or changed circumstance prompts a re-evaluation of our practices. But in general, we do what we mean and we mean what we do, and constitutional law takes its shape accordingly.

In its 2021-2022 term, traditionalism was the Supreme Court’s preferred method in a number of high-profile cases. Consider New York State Rifle and Pistol Association v. Bruen, a 2022 decision that concerned a New York law that strictly limited the carrying of guns outside the home. Justice Thomas, writing for the majority, held that New York’s requirement to demonstrate a “special need for self-protection” before the state would issue a handgun permit for self-defense outside the home violated the Second Amendment.

The “historical tradition” of handgun regulation, Justice Thomas argued, established the limits of the right to keep and bear arms. He noted that the practices of regulation “from before, during and even after the founding” of the United States indicated “no such tradition in the historical materials,” which suggested that a long, unbroken line of tradition, stretching from medieval England to early 20th century America, was at odds with New York’s law. The opinion granted the existence of scattered 19th-century regulations akin to New York’s, but argued that these were dwarfed by the dearth of analogous traditions of gun regulation over time and across state and local communities.

One can see a similar traditionalist approach in Dobbs, where Justice Alito, writing for the court, examined the government practices of abortion regulation before, during and after ratification of the 14th Amendment, concluding that there is no constitutional right to abortion in part because there is “an unbroken tradition of prohibiting abortion” that persisted “from the earliest days of the common law until 1973.”

Likewise, in Kennedy v. Bremerton School District, the Supreme Court decided in 2022 that a public school football coach who prayed on the field after games was not in violation of the Establishment Clause by holding, in an opinion by Justice Neil Gorsuch, that this was not analogous to prayer practices long considered Establishment Clause violations. And in the unanimously decided case Houston Community College System v. Wilson, the court in 2022 held that “long settled and established practice” determined that elected bodies do not violate their members’ freedom of speech when they censure one of their members.

For some critics, the invocation of “tradition” sets off alarm bells. After all, our country looks very different today, demographically and otherwise, than it did hundreds of years ago, when political power was held by relatively few and denied to others for illegitimate reasons. These critics ask how well traditionalism deals with the contemporary realities of American democracy.

The answer to this legitimate question is: Compared to what? Consider again originalism and living constitutionalism. These approaches, different as they are from each other, are both suited to elite actors working at the nerve centers of legal and political power. Both depend on the preferences and findings of the legal professional class. Originalism privileges the centuries-old writings of illustrious figures of the founding or Reconstruction era as determined by today’s most brilliant legal historians and theorists. Living constitutionalism privileges the high ideals of today’s most prominent academics and judges.

Traditionalism, by contrast, looks to the ordinary practices of the American people across time and throughout the country. In democracies, people obey the law because they believe it is legitimate, and the law acquires legitimacy when the people believe they have had a hand, direct or indirect, in shaping it. True, the practices of “the people” may be repudiated or upended — no political tradition is perfect — but while they endure, their origin in popular sovereignty is a presumptive reason to preserve them.

Tradition, in the law and elsewhere, illuminates a basic fact of human life: We admire and want to unite ourselves with ways of being and of doing that have endured for centuries before we were born and that we hope will endure long after we are gone. At its core, this is what constitutional traditionalism is about: a desire for excellence, understood as human achievement over many generations and in many areas of life, that serves the common good of our society.

Not all traditions are worthy of preservation. Some are rightly jettisoned as the illegitimate vestiges of days gone by. But many, and perhaps most, deserve our solicitude and need a concerted defense.

Traditions can be fragile things. To the extent that a revitalized practice of constitutional interpretation is possible, it will depend on determining the content of the Constitution with an eye to their sustenance and restoration.
