Understanding Assignments

What this handout is about.

The first step in any successful college writing venture is reading the assignment. While this sounds like a simple task, it can be a tough one. This handout will help you unravel your assignment and begin to craft an effective response. Much of the following advice will involve translating typical assignment terms and practices into meaningful clues to the type of writing your instructor expects. See our short video for more tips.

Basic beginnings

Regardless of the assignment, department, or instructor, adopting these two habits will serve you well :

• Read the assignment carefully as soon as you receive it. Do not put this task off—reading the assignment at the beginning will save you time, stress, and problems later. An assignment can look pretty straightforward at first, particularly if the instructor has provided lots of information. That does not mean it will not take time and effort to complete; you may even have to learn a new skill to complete the assignment.
• Ask the instructor about anything you do not understand. Do not hesitate to approach your instructor. Instructors would prefer to set you straight before you hand the paper in. That’s also when you will find their feedback most useful.

Assignment formats

Many assignments follow a basic format. Assignments often begin with an overview of the topic, include a central verb or verbs that describe the task, and offer some additional suggestions, questions, or prompts to get you started.

An Overview of Some Kind

The instructor might set the stage with some general discussion of the subject of the assignment, introduce the topic, or remind you of something pertinent that you have discussed in class. For example:

“Throughout history, gerbils have played a key role in politics,” or “In the last few weeks of class, we have focused on the evening wear of the housefly …”

The Task of the Assignment

Pay attention; this part tells you what to do when you write the paper. Look for the key verb or verbs in the sentence. Words like analyze, summarize, or compare direct you to think about your topic in a certain way. Also pay attention to words such as how, what, when, where, and why; these words guide your attention toward specific information. (See the section in this handout titled “Key Terms” for more information.)

“Analyze the effect that gerbils had on the Russian Revolution”, or “Suggest an interpretation of housefly undergarments that differs from Darwin’s.”

Additional Material to Think about

Here you will find some questions to use as springboards as you begin to think about the topic. Instructors usually include these questions as suggestions rather than requirements. Do not feel compelled to answer every question unless the instructor asks you to do so. Pay attention to the order of the questions. Sometimes they suggest the thinking process your instructor imagines you will need to follow to begin thinking about the topic.

“You may wish to consider the differing views held by Communist gerbils vs. Monarchist gerbils, or Can there be such a thing as ‘the housefly garment industry’ or is it just a home-based craft?”

These are the instructor’s comments about writing expectations:

“Be concise”, “Write effectively”, or “Argue furiously.”

Technical Details

These instructions usually indicate format rules or guidelines.

“Your paper must be typed in Palatino font on gray paper and must not exceed 600 pages. It is due on the anniversary of Mao Tse-tung’s death.”

The assignment’s parts may not appear in exactly this order, and each part may be very long or really short. Nonetheless, being aware of this standard pattern can help you understand what your instructor wants you to do.

Interpreting the assignment

Ask yourself a few basic questions as you read and jot down the answers on the assignment sheet:

Why did your instructor ask you to do this particular task?

Who is your audience.

• What kind of evidence do you need to support your ideas?

What kind of writing style is acceptable?

• What are the absolute rules of the paper?

Try to look at the question from the point of view of the instructor. Recognize that your instructor has a reason for giving you this assignment and for giving it to you at a particular point in the semester. In every assignment, the instructor has a challenge for you. This challenge could be anything from demonstrating an ability to think clearly to demonstrating an ability to use the library. See the assignment not as a vague suggestion of what to do but as an opportunity to show that you can handle the course material as directed. Paper assignments give you more than a topic to discuss—they ask you to do something with the topic. Keep reminding yourself of that. Be careful to avoid the other extreme as well: do not read more into the assignment than what is there.

Of course, your instructor has given you an assignment so that he or she will be able to assess your understanding of the course material and give you an appropriate grade. But there is more to it than that. Your instructor has tried to design a learning experience of some kind. Your instructor wants you to think about something in a particular way for a particular reason. If you read the course description at the beginning of your syllabus, review the assigned readings, and consider the assignment itself, you may begin to see the plan, purpose, or approach to the subject matter that your instructor has created for you. Given your instructor’s efforts, it helps to answer the question: What is my purpose in completing this assignment? Is it to gather research from a variety of outside sources and present a coherent picture? Is it to take material I have been learning in class and apply it to a new situation? Is it to prove a point one way or another? Key words from the assignment can help you figure this out. Look for key terms in the form of active verbs that tell you what to do.

Key Terms: Finding Those Active Verbs

Here are some common key words and definitions to help you think about assignment terms:

Information words Ask you to demonstrate what you know about the subject, such as who, what, when, where, how, and why.

• define —give the subject’s meaning (according to someone or something). Sometimes you have to give more than one view on the subject’s meaning
• describe —provide details about the subject by answering question words (such as who, what, when, where, how, and why); you might also give details related to the five senses (what you see, hear, feel, taste, and smell)
• explain —give reasons why or examples of how something happened
• illustrate —give descriptive examples of the subject and show how each is connected with the subject
• summarize —briefly list the important ideas you learned about the subject
• trace —outline how something has changed or developed from an earlier time to its current form
• research —gather material from outside sources about the subject, often with the implication or requirement that you will analyze what you have found

Relation words Ask you to demonstrate how things are connected.

• compare —show how two or more things are similar (and, sometimes, different)
• contrast —show how two or more things are dissimilar
• apply—use details that you’ve been given to demonstrate how an idea, theory, or concept works in a particular situation
• cause —show how one event or series of events made something else happen
• relate —show or describe the connections between things

Interpretation words Ask you to defend ideas of your own about the subject. Do not see these words as requesting opinion alone (unless the assignment specifically says so), but as requiring opinion that is supported by concrete evidence. Remember examples, principles, definitions, or concepts from class or research and use them in your interpretation.

• assess —summarize your opinion of the subject and measure it against something
• prove, justify —give reasons or examples to demonstrate how or why something is the truth
• evaluate, respond —state your opinion of the subject as good, bad, or some combination of the two, with examples and reasons
• support —give reasons or evidence for something you believe (be sure to state clearly what it is that you believe)
• synthesize —put two or more things together that have not been put together in class or in your readings before; do not just summarize one and then the other and say that they are similar or different—you must provide a reason for putting them together that runs all the way through the paper
• analyze —determine how individual parts create or relate to the whole, figure out how something works, what it might mean, or why it is important
• argue —take a side and defend it with evidence against the other side

More Clues to Your Purpose As you read the assignment, think about what the teacher does in class:

• What kinds of textbooks or coursepack did your instructor choose for the course—ones that provide background information, explain theories or perspectives, or argue a point of view?
• In lecture, does your instructor ask your opinion, try to prove her point of view, or use keywords that show up again in the assignment?
• What kinds of assignments are typical in this discipline? Social science classes often expect more research. Humanities classes thrive on interpretation and analysis.
• How do the assignments, readings, and lectures work together in the course? Instructors spend time designing courses, sometimes even arguing with their peers about the most effective course materials. Figuring out the overall design to the course will help you understand what each assignment is meant to achieve.

Now, what about your reader? Most undergraduates think of their audience as the instructor. True, your instructor is a good person to keep in mind as you write. But for the purposes of a good paper, think of your audience as someone like your roommate: smart enough to understand a clear, logical argument, but not someone who already knows exactly what is going on in your particular paper. Remember, even if the instructor knows everything there is to know about your paper topic, he or she still has to read your paper and assess your understanding. In other words, teach the material to your reader.

Aiming a paper at your audience happens in two ways: you make decisions about the tone and the level of information you want to convey.

• Tone means the “voice” of your paper. Should you be chatty, formal, or objective? Usually you will find some happy medium—you do not want to alienate your reader by sounding condescending or superior, but you do not want to, um, like, totally wig on the man, you know? Eschew ostentatious erudition: some students think the way to sound academic is to use big words. Be careful—you can sound ridiculous, especially if you use the wrong big words.
• The level of information you use depends on who you think your audience is. If you imagine your audience as your instructor and she already knows everything you have to say, you may find yourself leaving out key information that can cause your argument to be unconvincing and illogical. But you do not have to explain every single word or issue. If you are telling your roommate what happened on your favorite science fiction TV show last night, you do not say, “First a dark-haired white man of average height, wearing a suit and carrying a flashlight, walked into the room. Then a purple alien with fifteen arms and at least three eyes turned around. Then the man smiled slightly. In the background, you could hear a clock ticking. The room was fairly dark and had at least two windows that I saw.” You also do not say, “This guy found some aliens. The end.” Find some balance of useful details that support your main point.

The Grim Truth

With a few exceptions (including some lab and ethnography reports), you are probably being asked to make an argument. You must convince your audience. It is easy to forget this aim when you are researching and writing; as you become involved in your subject matter, you may become enmeshed in the details and focus on learning or simply telling the information you have found. You need to do more than just repeat what you have read. Your writing should have a point, and you should be able to say it in a sentence. Sometimes instructors call this sentence a “thesis” or a “claim.”

So, if your instructor tells you to write about some aspect of oral hygiene, you do not want to just list: “First, you brush your teeth with a soft brush and some peanut butter. Then, you floss with unwaxed, bologna-flavored string. Finally, gargle with bourbon.” Instead, you could say, “Of all the oral cleaning methods, sandblasting removes the most plaque. Therefore it should be recommended by the American Dental Association.” Or, “From an aesthetic perspective, moldy teeth can be quite charming. However, their joys are short-lived.”

Convincing the reader of your argument is the goal of academic writing. It doesn’t have to say “argument” anywhere in the assignment for you to need one. Look at the assignment and think about what kind of argument you could make about it instead of just seeing it as a checklist of information you have to present. What kind of evidence do you need?

There are many kinds of evidence, and what type of evidence will work for your assignment can depend on several factors–the discipline, the parameters of the assignment, and your instructor’s preference. Should you use statistics? Historical examples? Do you need to conduct your own experiment? Can you rely on personal experience? See our handout on evidence for suggestions on how to use evidence appropriately.

Make sure you are clear about this part of the assignment, because your use of evidence will be crucial in writing a successful paper. You are not just learning how to argue; you are learning how to argue with specific types of materials and ideas. Ask your instructor what counts as acceptable evidence. You can also ask a librarian for help. No matter what kind of evidence you use, be sure to cite it correctly—see the UNC Libraries citation tutorial .

You cannot always tell from the assignment just what sort of writing style your instructor expects. The instructor may be really laid back in class but still expect you to sound formal in writing. Or the instructor may be fairly formal in class and ask you to write a reflection paper where you need to use “I” and speak from your own experience.

Try to avoid false associations of a particular field with a style (“art historians like wacky creativity,” or “political scientists are boring and just give facts”) and look instead to the types of readings you have been given in class. No one expects you to write like Plato—just use the readings as a guide for what is standard or preferable to your instructor. When in doubt, ask your instructor about the level of formality she or he expects.

No matter what field you are writing for or what facts you are including, if you do not write so that your reader can understand your main idea, you have wasted your time. So make clarity your main goal. For specific help with style, see our handout on style .

Technical details about the assignment

The technical information you are given in an assignment always seems like the easy part. This section can actually give you lots of little hints about approaching the task. Find out if elements such as page length and citation format (see the UNC Libraries citation tutorial ) are negotiable. Some professors do not have strong preferences as long as you are consistent and fully answer the assignment. Some professors are very specific and will deduct big points for deviations.

Usually, the page length tells you something important: The instructor thinks the size of the paper is appropriate to the assignment’s parameters. In plain English, your instructor is telling you how many pages it should take for you to answer the question as fully as you are expected to. So if an assignment is two pages long, you cannot pad your paper with examples or reword your main idea several times. Hit your one point early, defend it with the clearest example, and finish quickly. If an assignment is ten pages long, you can be more complex in your main points and examples—and if you can only produce five pages for that assignment, you need to see someone for help—as soon as possible.

Tricks that don’t work

Your instructors are not fooled when you:

• spend more time on the cover page than the essay —graphics, cool binders, and cute titles are no replacement for a well-written paper.
• use huge fonts, wide margins, or extra spacing to pad the page length —these tricks are immediately obvious to the eye. Most instructors use the same word processor you do. They know what’s possible. Such tactics are especially damning when the instructor has a stack of 60 papers to grade and yours is the only one that low-flying airplane pilots could read.
• use a paper from another class that covered “sort of similar” material . Again, the instructor has a particular task for you to fulfill in the assignment that usually relates to course material and lectures. Your other paper may not cover this material, and turning in the same paper for more than one course may constitute an Honor Code violation . Ask the instructor—it can’t hurt.
• get all wacky and “creative” before you answer the question . Showing that you are able to think beyond the boundaries of a simple assignment can be good, but you must do what the assignment calls for first. Again, check with your instructor. A humorous tone can be refreshing for someone grading a stack of papers, but it will not get you a good grade if you have not fulfilled the task.

Critical reading of assignments leads to skills in other types of reading and writing. If you get good at figuring out what the real goals of assignments are, you are going to be better at understanding the goals of all of your classes and fields of study.

How to Decipher the Paper Assignment

Many instructors write their assignment prompts differently. By following a few steps, you can better understand the requirements for the assignment. The best way, as always, is to ask the instructor about anything confusing.

• Read the prompt the entire way through once. This gives you an overall view of what is going on.
• Underline or circle the portions that you absolutely must know. This information may include due date, research (source) requirements, page length, and format (MLA, APA, CMS).
• Underline or circle important phrases. You should know your instructor at least a little by now - what phrases do they use in class? Does he repeatedly say a specific word? If these are in the prompt, you know the instructor wants you to use them in the assignment.
• Think about how you will address the prompt. The prompt contains clues on how to write the assignment. Your instructor will often describe the ideas they want discussed either in questions, in bullet points, or in the text of the prompt. Think about each of these sentences and number them so that you can write a paragraph or section of your essay on that portion if necessary.
• Rank ideas in descending order, from most important to least important. Instructors may include more questions or talking points than you can cover in your assignment, so rank them in the order you think is more important. One area of the prompt may be more interesting to you than another.
• Ask your instructor questions if you have any.

After you are finished with these steps, ask yourself the following:

• What is the purpose of this assignment? Is my purpose to provide information without forming an argument, to construct an argument based on research, or analyze a poem and discuss its imagery?
• Who is my audience? Is my instructor my only audience? Who else might read this? Will it be posted online? What are my readers' needs and expectations?
• What resources do I need to begin work? Do I need to conduct literature (hermeneutic or historical) research, or do I need to review important literature on the topic and then conduct empirical research, such as a survey or an observation? How many sources are required?
• Who - beyond my instructor - can I contact to help me if I have questions? Do you have a writing lab or student service center that offers tutorials in writing?

Poster or Song Analysis: Poster or Song? Poster!

Goals : To systematically consider the rhetorical choices made in either a poster or a song. She says that all the time.

Things to Consider: ah- talking points

• how the poster addresses its audience and is affected by context I'll do this first - 1.
• general layout, use of color, contours of light and shade, etc.
• use of contrast, alignment, repetition, and proximity C.A.R.P. They say that, too. I'll do this third - 3.
• the point of view the viewer is invited to take, poses of figures in the poster, etc. any text that may be present
• possible cultural ramifications or social issues that have bearing I'll cover this second - 2.
• ethical implications
• how the poster affects us emotionally, or what mood it evokes
• the poster's implicit argument and its effectiveness said that was important in class, so I'll discuss this last - 4.
• how the song addresses its audience
• lyrics: how they rhyme, repeat, what they say
• use of music, tempo, different instruments
• possible cultural ramifications or social issues that have bearing
• emotional effects
• the implicit argument and its effectiveness

These thinking points are not a step-by-step guideline on how to write your paper; instead, they are various means through which you can approach the subject. I do expect to see at least a few of them addressed, and there are other aspects that may be pertinent to your choice that have not been included in these lists. You will want to find a central idea and base your argument around that. Additionally, you must include a copy of the poster or song that you are working with. Really important!

I will be your audience. This is a formal paper, and you should use academic conventions throughout.

Academic Argument Essay

5-7 pages, Times New Roman 12 pt. font, 1 inch margins.

Minimum of five cited sources: 3 must be from academic journals or books

• Design Plan due: Thurs. 10/19
• Rough Draft due: Monday 10/30
• Final Draft due: Thurs. 11/9

Remember this! I missed the deadline last time

The design plan is simply a statement of purpose, as described on pages 40-41 of the book, and an outline. The outline may be formal, as we discussed in class, or a printout of an Open Mind project. It must be a minimum of 1 page typed information, plus 1 page outline.

This project is an expansion of your opinion editorial. While you should avoid repeating any of your exact phrases from Project 2, you may reuse some of the same ideas. Your topic should be similar. You must use research to support your position, and you must also demonstrate a fairly thorough knowledge of any opposing position(s). 2 things to do - my position and the opposite.

Your essay should begin with an introduction that encapsulates your topic and indicates 1 the general trajectory of your argument. You need to have a discernable thesis that appears early in your paper. Your conclusion should restate the thesis in different words, 2 and then draw some additional meaningful analysis out of the developments of your argument. Think of this as a "so what" factor. What are some implications for the future, relating to your topic? What does all this (what you have argued) mean for society, or for the section of it to which your argument pertains? A good conclusion moves outside the topic in the paper and deals with a larger issue.

You should spend at least one paragraph acknowledging and describing the opposing position in a manner that is respectful and honestly representative of the opposition’s 3 views. The counterargument does not need to occur in a certain area, but generally begins or ends your argument. Asserting and attempting to prove each aspect of your argument’s structure should comprise the majority of your paper. Ask yourself what your argument assumes and what must be proven in order to validate your claims. Then go step-by-step, paragraph-by-paragraph, addressing each facet of your position. Most important part!

Finally, pay attention to readability . Just because this is a research paper does not mean that it has to be boring. Use examples and allow your opinion to show through word choice and tone. Proofread before you turn in the paper. Your audience is generally the academic community and specifically me, as a representative of that community. Ok, They want this to be easy to read, to contain examples I find, and they want it to be grammatically correct. An assignment or assignment of contract is a way to profit from a real estate transaction without becoming the owner of the property.

The assignment method is a standard tool in a real estate wholesaler’s kit and lowers the barrier to entry for a real estate investor because it does not require the wholesaler to use much (or any) of their own money to profit from a deal.

Contract assignment is a common wholesaling strategy where the seller and the wholesaler (acting as a middleman in this case) sign an agreement giving the wholesaler the sole right to buy a property at a specified price, within a certain period of time.

The wholesaler then finds another buyer and assigns the contract to him or her. The wholesaler isn’t selling the property to the end buyer because the wholesaler never takes title to the property during the process. The wholesaler is simply selling the contract, which gives the end buyer the right to buy the property in accordance with the original purchase agreement.

In doing this, the wholesaler can earn an assignment fee for putting the deal together.

Some states require a real estate wholesaler to be a licensed real estate agent, and the assignment strategy can’t be used for HUD homes and REOs.

The process for assigning a contract follows some common steps. In summary, it looks like this:

• Find the right property.
• Get a purchase agreement signed.
• Find an end buyer.
• Assign the contract.
• Close the transaction and collect your assignment fee.

We describe each step in the process below.

1. Find the Right Property

This is where the heavy lifting happens—investors use many different marketing tactics to find leads and identify properties that work with their investing strategy. Typically, for wholesaling to work, a wholesaler needs a motivated seller who wants to unload the property as soon as possible. That sense of urgency works to the wholesaler’s advantage in negotiating a price that will attract buyers and cover their assignment fee.

2. Get a Purchase Agreement Signed

Once a motivated seller has agreed to sell their property at a discounted price, they will sign a purchase agreement with the wholesaler. The purchase agreement needs to contain specific, clear language that allows the wholesaler (for example, you) to assign their rights in the agreement to a third party.

Note that most standard purchase agreements do not include this language by default. If you plan to assign this contract, make sure this language is included. You can consult an attorney to cover the correct verbiage in a way that the seller understands it.

This can’t be stressed enough: It’s extremely important for a wholesaler to communicate with their seller about their intent to assign the contract. Many sellers are not familiar with the assignment process, so if the role of the buyer is going to change along the way, the seller needs to be aware of this on or before they sign the original purchase agreement.

3. Find an End Buyer

This is the other half of a wholesaler’s job—marketing to find buyers. Once they find an end buyer, the wholesaler can assign the contract to the new party and work with the original seller and the end buyer to schedule a closing date.

4. Assign the Contract

Assigning the contract works through a simple assignment agreement. This agreement allows the end buyer to step into the wholesaler’s shoes as the buyer in the original contract.

In other words, this document “replaces” the wholesaler with the new end buyer.

Most assignment contracts include language for a nonrefundable deposit from the end buyer, which protects the wholesaler if the buyer backs out. While you can download assignment contract templates online, most experts recommend having an attorney review your contracts. The assignment wording has to be precise and comply with applicable local laws to protect you from issues down the road.

5. Close the Transaction and Collect the Assignment Fee

Finally, you will receive your assignment fee (or wholesale fee) when the end buyer closes the deal.

The assignment fee is often the difference between the original purchase price (the price that the seller agreed with the wholesaler) and the end buyer’s purchase price (the price the wholesaler agreed with the end buyer), but it can also be a percentage of it or even a flat amount.

According to UpCounsel, most contract assignments are done for about $5,000, although depending on the property and the market, it could be higher or lower.

IMPORTANT: the end buyer will see precisely how much the assignment fee is. This is because they must sign two documents that show the original price and the assignment fee: the closing statement and the assignment agreement, respectively, to close the transaction.

In many cases, if the assignment fee is a reasonable amount relative to the purchase price, most buyers won’t take any issue with the wholesaler taking their fee—after all, the wholesaler made the deal happen, and it’s compensation for their efforts. However, if the assignment fee is too big (such as the wholesaler taking $20,000 from an original purchase price of $10,000, while the end buyer buys it for $50,000), it may ruffle some feathers and lead to uncomfortable questions.

In these instances where the wholesaler has a substantially higher profit margin, a wholesaler can instead do a double closing . In a double closing, the wholesaler closes two separate deals (one with the seller and another with the buyer) on the same day, but the seller and buyer cannot see the numbers and overall profit margin the wholesaler makes between the two transactions. This makes a double closing a much safer way to conclude a transaction.

Assigning contracts is a way to lower the barrier to entry for many new real estate investors; because they don’t need to put up their own money to buy a property or assume any risk in financing a deal.

The wholesaler isn’t part of the title chain, which streamlines the process and avoids the hassle of closing two times. Compared to the double-close strategy, assignment contracts require less paperwork and are usually less costly (because there is only one closing occurring, rather than two separate transactions).

On the downside, the wholesaler has to sell the property as-is, because they don’t own it at any point and they cannot make repairs or renovations to make the property look more attractive to a potential buyer. Calculated Assignment is a Duration Type that you can set for a task in Adobe Workfront. For general information about Duration Types in Workfront, see Overview of Task Duration and Duration Type .

Overview of the Calculated Assignment Duration Type

When you use a Calculated Assignment Duration Type, you must specify both a Duration and a number of Planned Hours for the task. Workfront then divides the amount of Planned Hours by the amount of hours in the Duration, then by the number of resources assigned to the task to calculate the allocation percentage (calculates the assignment) for each resource. Each resource will equally have the same value for their allocation percentage. In this case, you cannot modify the allocation values for each resource.

Your Workfront or a group administrator can set the default Duration Type of your system or group as Calculated Assignment. In this case, all new tasks will be created with this Duration Type. For information about changing your task and issue preferences as part of your system-level or group-level project preferences, see Configure system-wide task and issue preferences .

In this case, the task has a default of a one-day Duration and a default of 0 hours of Planned Hours. Unless the project manager sets a more accurate Duration and populates the Planned Hours field with a realistic estimate, then resources appear underallocated.

Calculated Assignment is the preferred Duration Type in the following situations:

When assignments have a window of activity but do not take the entire Duration allotted to complete their work. For example, you are assigned to deliver a report to your supervisor by the end of the week. You have a five-day duration, but it will only take you ten hours to draft the document.

When a single resource is assigned to a task because the project manager can estimate the planned Duration and planned amount of effort independent of each other.

You can use the Calculated Work Duration Type for the same result, but the project manager must input a percentage allocation for the resource in order to affect the calculated value for Planned Hours. This makes project planning more difficult and time-consuming.

The allocation percentage for each resource is calculated as follows:

For example, in the scenario outlined below, each task has a Duration of 3 days. The project manager manually enters both the Duration (3 days or 24 hours) and Planned Hours, and as a result, the allocation percentage (or assignment percentage) is calculated:

  What is a Wage Assignment?

A wage assignment is a special process that allows the court to order an employer to make direct payments to the custodial parent from the supporting parent’s wages. You can also directly apply to the court for a wage assignment. Remember that the notice of this action must be served on the paying parent’s employer.

The employer will deduct child support like any other deduction from the paying parent’s paycheck and send the money to the custodial parent. If the non-paying parent holds stable employment, this is a valuable tool for starting this process.

What Can Impact Wage Assignment?

What is the wage assignment duration, how does child support wage assignments function, how do courts enforce child support orders, when do i need to contact a lawyer.

If the non-custodial parent changes jobs, he must immediately notify the child support agency so the new employer can begin making the wage assignment payments. If the non-custodial parent becomes unemployed and receives unemployment compensation, the child support payment will usually be deducted from the unemployment benefits.

If the non-custodial parent is not receiving unemployment benefits, he is still mandated to make child support payments. However, it is recommended to report the loss of income to the court to ensure that the child support order adjusts accordingly.

A wage assignment is available only if the non-custodial parent is a salaried employee. If the non-custodial parent is self-employed or is otherwise not subject to wage withholding, he instead may be ordered to provide the child support payments directly to the child support agency.

If the non-custodial parent fails to make the required payments, the amount owed may be deducted from the non-custodial parent’s federal and state income tax refunds. Each state has its own form of interstate enforcement legislation, such as the Uniform Reciprocal Enforcement of Support Act (URESA), which allows for the enforcement of support orders across state lines more uniformly.

The wage assignment continues until the obligation to pay child support ends, whether there is a custody modification, the non-custodial parent passes away, or the child becomes emancipated. Emancipation happens when the child reaches the state’s age of majority, which is eighteen, according to the majority of states.

Emancipation may also occur if the child marries, enlists in the armed services, or leaves the care and control of the custodial parent. However, if the child returns to live with the custodial parent before reaching the age of majority, the obligation to pay child support usually resumes, and the non-custodial parent’s income will again be subject to a wage assignment.

After the court decides the amount of child or spousal support, the wage assignment informs the employer how much to deduct from each paycheck and where to send the payment. With a wage assignment, if the parent ordered to pay support is regularly employed, the employer will deduct the support payments directly from their paycheck.

Most support is paid this way, and federal, and state laws mandate it in almost all child support cases. Typically, it is the employer’s responsibility to withhold the wages if there is a wage assignment. If the parent has other wage assignments, child support is first deducted before other withholding orders. Spousal or partner support assignments come after child support wage assignments are in place.

Wage assignments are usually incurred for debts that have gone unpaid for a long time. Wage assignments can be split into two categories: voluntary and involuntary. Employees may sometimes choose a voluntary wage assignment to pay union dues or contribute to a retirement fund. Moreover, employees may even voluntarily opt into a wage assignment plan as a part of a payday loan repayment promise.

When a wage assignment is undertaken voluntarily or required by a court and served to an employer, it is considered part of an employer’s payroll procedure. The employee has to do nothing, as their paycheck is already decreased by the amount of the assignment and noted on their pay stub.

As child support is usually ordered as a monthly amount, the calculation is provided to the employer as to the proper amount to withhold from each paycheck based on whether the employee is paid on a weekly, bi-weekly, semi-monthly, or other basis to correspond to the monthly amount ordered.

For instance, if child support was ordered for $200 a month and the employee was paid weekly, the withholding order would direct the employer to take out $48.43 from each paycheck for child support. Once the employer removes the calculated amount from the parent’s paycheck, they send it to the Support Payment Clearinghouse. The payment is then accounted for and recorded by the Clearinghouse and is sent on to the custodial parent .

Generally, if the non-custodial parent starts a new job, they are responsible for giving the wage assignment to their new employer. They are responsible for notifying the Clerk of the Superior Court and Support Payment Clearinghouse of their new employer’s contact information within 10 days. An employer who fails, without a good cause, to adhere to the terms of a wage assignment is liable for the amount overdue.

The employer may be entitled to charge a small administrative fee for processing the required payments. Still, it is against the law for an employer to terminate an employee due to a court-ordered wage assignment for child support. A wage assignment is not mandated when the non-custodial parent is self-employed, not employed, or does not have a regular source of income. In those situations, they are responsible for making payments directly to the Support Payment Clearinghouse.

Judges enforce child support orders, usually with “income assignments.” When judges form child support orders, they order the paying parent’s employer to take the child support out of their wages and send it to the Department of Revenue (DOR/CSE) Child Support Enforcement Division.

The DOR then sends the child support order to you. As mentioned earlier, child support taken out of the wages is called an “income assignment” or “wage assignment.” The income assignment is one of the primary ways judges ensure that child support is paid on time. In some cases, parents fall behind in paying their child support.

In some situations, they disobey the child support order. When that happens, you may have to return to the court to enforce your child support order . Making sure the paying parent follows through with the child support order is considered “enforcing” the order.

Courts can enforce child support orders by holding the paying parent in contempt. DOR/CSE can enforce child support orders by:

• Collecting overdue child support;
• Levying your bank account;
• Charging interest and penalties;
• Increasing the amount withheld from your paycheck by 25%;
• Placing a lien on your real estate or personal property;
• Seizing your personal property;
• Suspending your license;
• Intercepting your tax refunds;
• Making it hard to get credit and;
• Filing a Complaint for Contempt.

If you do not receive the required child support payments or have failed to make the necessary payments. Both situations have legal remedies available, and you will need to seek a local child support attorney to determine your options within your jurisdiction.

What is TDY?

The U.S. Military has three primary types of military travel orders:

• Permanent Change of Station (PCS)
• Temporary Duty (TDY)
• Deployments Orders

It is important to keep in mind that the three types of military assignment orders are not the same and each has its own characteristics.

Your military orders may affect how long you serve at the post, the specific location, and special duty pay.

Temporary Duty (TDY) is defined by the Department of Defense as:

Duty at one or more locations, away from the permanent duty station (PDS), under an order, providing for further assignment or pending further assignment, to return to the old PDS or to proceed to a new PDS.

Military branches under the U.S. Armed Forces have different references for Military TDY, like TAD (temporary additional duty) or TCS (temporary change of station).

However, they all mean basically the same thing that your military orders are temporary.

The primary difference between Military TDY and other orders is that it grants authorization for a service member to perform work away from the permanent duty station.

The Department of Defense requires the label Military TDY (or one of its variants) to approve travel pay, per diem, and coverage of other expenses to assist the soldier.

Since the assignment is temporary, the service member can expect a shorter stay than a permanent station assignment, however, the length of the orders may vary.

The individual details of TDY orders are fleshed out with each commitment.

The specifics of your Military TDY outline expected duration, amount of travel pay, coverage of expenses, housing and food support, transportation, and other forms of assistance.

How long is a TDY?

Military TDY is temporary for military orders, so the length is generally not longer than 180 days.

Temporary duty orders may range anywhere from a few days to a half year.

Long-term TDY is any orders which specify longer than 30 days.

TDY per diem rates depend on the location you have orders for. It will also include reimbursement for lodging, meals, and incidentals.

Is TDY considered a deployment?

Technically there is a difference between a temporary duty assignment (TDY) and Deployment, even though they are both military orders.

Deployments are similar to military TDY, except that the service member is assigned to a specific operation.

Therefore, deployments usually reference combat operations that take place overseas.

When most civilians think of military orders, they commonly associate everything with being deployed, though that’s not always the case based on the actual military definition.

Deployment refers to assigning military personnel from a home station to somewhere outside the continental United States.

Mobilizations are also classified as deployments under the Department of Defense guidelines.

How does a TDY differ from a deployment?

The biggest difference between deployments and temporary duty assignments is the length of the orders.

Military TDY is short-term, with even longer stints requiring less than a half year of commitment.

On the other hand, deployments are typically longer and involve assignments outside the United States.

Additionally, deployments involve assignments to specific operations and usually in combat situations.

However, both types of military orders have similarities.

For example, military personnel must leave their home station for a different location under each type of order.

Military TDY is not always as serious as deployments.

For instance, a temporary duty assignment could mean nothing more than attending school, conferences, or a military-sponsored event.

Or it could pertain to a regular part of military duty where frequent travel is mandatory and the service member hopes to receive some form of compensation for their travel exs.

There are cases where military personnel earn TDY status even when working in the same geographic area as the home base to justify lodging and meal expenses associated with the duty.

Soldiers also rely on military TDY for house hunting and other searches when considering a new permanent change of station or out-processing from military service.

Can I go with my husband/wife on a TDY?

One of the many perks of temporary duty assignments is that you can occasionally bring along the family.

The same is not true of deployments where it would put your spouse or other family members in danger.

If given the chance to bring along a spouse for your temporary duty assignment, you should welcome the opportunity, but keep in mind that pier diem rates are only calculated for the service member.

A mortgage is a legally binding agreement between a home buyer and a lender that dictates a borrower's ability to pay off a loan. Every mortgage has an interest rate, a term length, and specific fees attached to it.

If you’re like most people who want to purchase a home, you’ll start by going to a bank or other lender to get a mortgage loan. Though you can choose your lender, after the mortgage loan is processed, your mortgage may be transferred to a different mortgage servicer . A transfer is also called an assignment of the mortgage. 

No matter what it’s called, this change of hands may also change who you’re supposed to make your house payments to and how the foreclosure process works if you default on your loan. That’s why if you’re a homeowner, it’s important to know how this process works. This article will provide an in-depth look at what an assignment of a mortgage entails and what impact it can have on homeownership.

Assignment of Mortgage – The Basics

When your original lender transfers your mortgage account and their interests in it to a new lender, that’s called an assignment of mortgage. To do this, your lender must use an assignment of mortgage document. This document ensures the loan is legally transferred to the new owner. It’s common for mortgage lenders to sell the mortgages to other lenders. Most lenders assign the mortgages they originate to other lenders or mortgage buyers.

Home Loan Documents

When you get a loan for a home or real estate, there will usually be two mortgage documents. The first is a mortgage or, less commonly, a deed of trust . The other is a promissory note. The mortgage or deed of trust will state that the mortgaged property provides the security interest for the loan. This basically means that your home is serving as collateral for the loan. It also gives the loan servicer the right to foreclose if you don’t make your monthly payments. The promissory note provides proof of the debt and your promise to pay it.

When a lender assigns your mortgage, your interests as the mortgagor are given to another mortgagee or servicer. Mortgages and deeds of trust are usually recorded in the county recorder’s office. This office also keeps a record of any transfers. When a mortgage is transferred so is the promissory note. The note will be endorsed or signed over to the loan’s new owner. In some situations, a note will be endorsed in blank, which turns it into a bearer instrument. This means whoever holds the note is the presumed owner.

Using MERS To Track Transfers

Banks have collectively established the Mortgage Electronic Registration System , Inc. (MERS), which keeps track of who owns which loans. With MERS, lenders are no longer required to do a separate assignment every time a loan is transferred. That’s because MERS keeps track of the transfers. It’s crucial for MERS to maintain a record of assignments and endorsements because these land records can tell who actually owns the debt and has a legal right to start the foreclosure process.

The assignment of mortgage needs to include the following:

The original information regarding the mortgage. Alternatively, it can include the county recorder office’s identification numbers. 

The borrower’s name.

The mortgage loan’s original amount.

The date of the mortgage and when it was recorded.

Usually, there will also need to be a legal description of the real property the mortgage secures, but this is determined by state law and differs by state.

Notice Requirements

The original lender doesn’t need to provide notice to or get permission from the homeowner prior to assigning the mortgage. But the new lender (sometimes called the assignee) has to send the homeowner some form of notice of the loan assignment. The document will typically provide a disclaimer about who the new lender is, the lender’s contact information, and information about how to make your mortgage payment. You should make sure you have this information so you can avoid foreclosure.

Mortgage Terms

When an assignment occurs your loan is transferred, but the initial terms of your mortgage will stay the same. This means you’ll have the same interest rate, overall loan amount, monthly payment, and payment due date. If there are changes or adjustments to the escrow account, the new lender must do them under the terms of the original escrow agreement. The new lender can make some changes if you request them and the lender approves. For example, you may request your new lender to provide more payment methods.

Taxes and Insurance

If you have an escrow account and your mortgage is transferred, you may be worried about making sure your property taxes and homeowners insurance get paid. Though you can always verify the information, the original loan servicer is responsible for giving your local tax authority the new loan servicer’s address for tax billing purposes. The original lender is required to do this after the assignment is recorded. The servicer will also reach out to your property insurance company for this reason.  

If you’ve received notice that your mortgage loan has been assigned, it’s a good idea to reach out to your loan servicer and verify this information. Verifying that all your mortgage information is correct, that you know who to contact if you have questions about your mortgage, and that you know how to make payments to the new servicer will help you avoid being scammed or making payments incorrectly.

What Is an Assignment?

Assignment most often refers to one of two definitions in the financial world:

• The transfer of an individual's rights or property to another person or business. This concept exists in a variety of business transactions and is often spelled out contractually.
• In trading, assignment occurs when an option contract is exercised. The owner of the contract exercises the contract and assigns the option writer to an obligation to complete the requirements of the contract.

Uses For Assignments

Assignment refers to the transfer of some or all property rights and obligations associated with an asset, property, contract, or other asset of value. to another entity through a written agreement.

Assignment rights happen every day in many different situations. A payee, like a utility or a merchant, assigns the right to collect payment from a written check to a bank. A merchant can assign the funds from a line of credit to a manufacturing third party that makes a product that the merchant will eventually sell. A trademark owner can transfer, sell, or give another person interest in the trademark or logo. A homeowner who sells their house assigns the deed to the new buyer.

To be effective, an assignment must involve parties with legal capacity, consideration, consent, and legality of the object.

A wage assignment is a forced payment of an obligation by automatic withholding from an employee’s pay. Courts issue wage assignments for people late with child or spousal support, taxes, loans, or other obligations. Money is automatically subtracted from a worker's paycheck without consent if they have a history of nonpayment. For example, a person delinquent on $100 monthly loan payments has a wage assignment deducting the money from their paycheck and sent to the lender. Wage assignments are helpful in paying back long-term debts.

Another instance can be found in a mortgage assignment. This is where a mortgage deed gives a lender interest in a mortgaged property in return for payments received. Lenders often sell mortgages to third parties, such as other lenders. A mortgage assignment document clarifies the assignment of contract and instructs the borrower in making future mortgage payments, and potentially modifies the mortgage terms.

A final example involves a lease assignment. This benefits a relocating tenant wanting to end a lease early or a landlord looking for rent payments to pay creditors. Once the new tenant signs the lease, taking over responsibility for rent payments and other obligations, the previous tenant is released from those responsibilities. In a separate lease assignment, a landlord agrees to pay a creditor through an assignment of rent due under rental property leases. The agreement is used to pay a mortgage lender if the landlord defaults on the loan or files for bankruptcy . Any rental income would then be paid directly to the lender.

Options Assignment

Options can be assigned when a buyer decides to exercise their right to buy (or sell) stock at a particular strike price . The corresponding seller of the option is not determined when a buyer opens an option trade, but only at the time that an option holder decides to exercise their right to buy stock. So an option seller with open positions is matched with the exercising buyer via automated lottery. The randomly selected seller is then assigned to fulfill the buyer's rights. This is known as an option assignment.

Once assigned, the writer (seller) of the option will have the obligation to sell (if a call option ) or buy (if a put option ) the designated number of shares of stock at the agreed-upon price (the strike price). For instance, if the writer sold calls they would be obligated to sell the stock, and the process is often referred to as having the stock called away . For puts, the buyer of the option sells stock (puts stock shares) to the writer in the form of a short-sold position.

Suppose a trader owns 100 call options on company ABC's stock with a strike price of $10 per share. The stock is now trading at $30 and ABC is due to pay a dividend shortly. As a result, the trader exercises the options early and receives 10,000 shares of ABC paid at $10. At the same time, the other side of the long call (the short call) is assigned the contract and must deliver the shares to the long.

NEW YORK (AP) — True love’s kiss or an invite to the Met Gala? Those in the rarified ranks of international celebrity — and Anna Wintour’s good graces — need not choose.

Stars of film, fashion, music, sports, politics and social media will ascend the steps of the Metropolitan Museum of Art on the first Monday in May — May 6, that is — to sip cocktails, have dinner and sample the new exhibit, “Sleeping Beauties: Reawakening Fashion.” As fashion’s biggest night approaches, it’s time for The Associated Press to issue the 2024 version of our annual guide.

SO WHAT IS THE POINT OF THE MET GALA?

It started in 1948 as a society midnight supper, and wasn’t even at the Met. Fast forward 70-plus years, and it’s one of the most photographed events in the world, renowned for its head-spinning red carpet — though the carpet isn’t always red.

It’s important to note, though, that the party has a purpose, raising money for the Met’s Costume Institute — nearly $22 million last year, a record for the self-funding department — and launching the annual spring exhibit that brings hundreds of thousands of visitors to the museum.

But it’s the carpet itself that draws the world’s eyes, with the 400-strong guest list the subject of rabid speculation until the last minute — a collection of luminaries that arguably makes for the highest celebrity wattage-per-square-foot of any party in the world.

WHO’S HOSTING THIS YEAR?

“Anna Wintour Me Preguntó,” Bad Bunny could sing. Multi-hyphenate Jennifer Lopez adds yet another role to her busy year. And then there are two Marvel stars who have been spending a lot of time in the desert lately: Zendaya , who has continued to stun on red carpets with her “Dune” and “Challengers” looks, and Chris Hemsworth , who is trading in Mjolnir for the upcoming “Furiosa.” (Hemsworth is, in fact, a first-time gala attendee. )

And, of course, Wintour herself.

WHAT DOES THE MET GALA THEME MEAN?

The theme revolves around “sleeping beauties,” but has little to do with fairytales. “Sleeping Beauties: Reawakening Fashion,” the title of the accompanying exhibit, refers to garments from the Costume Institute’s collection that have been “in slumber” and now will be on display, some too fragile to hang upright lest they disintegrate. Curator Andrew Bolton picked 250 pieces spanning four centuries.

The theme is accompanied by a dress code — this year, it’s “The Garden of Time.” The theme and dress code are often interpreted ... loosely. So there’s a chance you may see an Aurora on the carpet, after all.

HOW MUCH DO I HAVE TO PAY FOR A MET GALA TICKET?

Wrong question. You cannot just buy a ticket. The right question is: If I were famous or powerful and got invited, how much would it cost?

OK, IF I WERE FAMOUS OR POWERFUL AND GOT INVITED, HOW MUCH WOULD IT COST?

Well, you might not pay yourself. Generally companies buy tables. A fashion label would then host its desired celebrities. Tickets have in the past cost $50,000 for an individual, and $300,000 or more for a table.

HOW CAN I WATCH?

You can watch the whole carpet unfold on a Vogue livestream. If you’re in New York, you can also join fans across the street, behind barricades, on Fifth Avenue or even further east on Madison. And the AP will have a livestream of departures from the Mark Hotel, where many gala guests get ready.

WHAT HAPPENS INSIDE?

Entering the museum, guests walk past what is usually an impossibly enormous flower arrangement in the lobby, with perhaps an orchestra playing nearby, and over to cocktails. Or, they head to view the exhibit. Cocktails are about 6 p.m. to 8 p.m., followed by dinner, but the most famous — or those who plan to make the biggest entrance — sometimes come (fashionably) later.

Even if president joe biden signs the bill into law, it will face a slew of legal challenges from tiktok and its supporters..

Time may be running out for TikTok .

In March, the House voted overwhelmingly to approve a bill that would force Chinese parent company ByteDance to sell TikTok’s U.S. operations. The bill then moved to the Senate , where its future was uncertain.

This week House Speaker Mike Johnson tied the measure to a foreign aid package for Ukraine and Israel, putting it on a fast track to becoming law and increasing the possibility of a ban in the United States. 

The House on Saturday approved the emergency spending package . The measure passed on a bipartisan 360-to-58 vote.

The Senate was expected to take up the measure next week and President Joe Biden has promised to sign it.

One possible hitch: Sen. Rand Paul (R-Ky.), who opposes the TikTok bill on First Amendment grounds and the foreign aid package it is attached to, says he wants to drag out the vote. 

But, he conceded in an essay published Friday: "The censors who abound in Congress will likely vote to ban TikTok or force a change in ownership. It will likely soon be law."

What would the TikTok bill do?

The bill would would be a major blow to the popular app which is used by as many as 170 million Americans. It would force ByteDance to sell TikTok’s U.S. operations within months of the legislation becoming law or face a nationwide ban .

"It is unfortunate that the House of Representatives is using the cover of important foreign and humanitarian assistance to once again jam through a ban bill that would trample the free speech rights of 170 million Americans, devastate 7 million businesses, and shutter a platform that contributes $24 billion to the U.S. economy, annually," TikTok said Saturday in an emailed statement.

What happens if Biden signs the TikTok bill?

Even if Biden signs the bill into law, it will face a slew of legal challenges from TikTok and its supporters . 

TikTok says it will exhaust all legal avenues before it considers divestiture from ByteDance. The popular app has successfully fought back similar measures in the courts.

When would ByteDance be forced to sell TikTok?

The bill itself gives ByteDance nearly a year to divest TikTok – nine months, with a possible three-month extension – far longer than the six-month deadline the original House measure proposed. 

Senate Commerce Committee Chair Maria Cantwell of Washington State said the extended deadline could help the bill survive legal challenges.

The Chinese Embassy is meeting with congressional staffers to lobby against the legislation, two Capitol Hill staffers told Politico.

Apple removed several apps including Meta’s WhatsApp and Threads from its app store in China at Beijing’s request in apparent retaliation for the legislation.

Why does Congress want to ban TikTok?

The popular app has faced scrutiny over its Chinese control which lawmakers say poses a national security threat.

TikTok says it has never been asked to provide U.S. user data to the Chinese government and wouldn’t anyway.

TikTok has also come under fire for the way its algorithm recommends videos to users, including videos on sensitive subjects and videos about the Israel-Hamas war

Where does Biden stand on a TikTok ban?

Biden supports a forced sale of TikTok but "has not called for a ban" on the app, his top science advisor said at Semafor's World Economy Summit.

"The big issue for TikTok from a national security perspective is about the vast amount of information that the platform is able to collect about people and specifically the fact that because of its ownership there’s there’s a direct line to the People’s Republic of China, which in in the geopolitics of today is a deeply concerning issue," Arati Prabhakar, the White House Director of Science and Technology Policy, said.

Who opposes the TikTok bill? Free speech advocates and tech groups

Free speech advocates have spoken out against the possibility of a TikTok ban. They say banning TikTok is the wrong way to address concerns about the practices of social media companies.

"Longstanding Supreme Court precedent protects Americans' First Amendment right to access information, ideas, and media from abroad. By banning TikTok, the bill would infringe on this right, and with no real pay-off,"Nadine Farid Johnson, policy director of the Knight First Amendment Institute at Columbia University, said in a statement. “China and other foreign adversaries could still purchase Americans’ sensitive data from data brokers on the open market. And they could still engage in disinformation campaigns using American-owned platforms.”

The Information Technology and Innovation Foundation, a science and technology policy think tank, also opposes the TikTok bill.

"The TikTok ban is bad policy, plain and simple," the foundation's vice president, Daniel Castro, said in a statement. And, he said, "it will not stop China’s techno-nationalist agenda."

Would TikTok parent company ByteDance sell TikTok? 

TikTok has said it considers any law that would force a sale as the equivalent of a ban because of the hurdles facing any deal. 

Divestiture also would require Beijing’s approval. Last year, the Chinese government said it opposed a forced sale.

Who would buy TikTok?

"While the price tag will be eye-popping, TikTok's strategic value and consumer platform will have a number of financial and tech strategic players interested," said Wedbush Securities analyst Dan Ives.

Investor groups and major tech giants including Microsoft, Apple and Oracle will consider bids, according to Ives. He also expects joint bids from a handful of Big Tech companies.

Former Treasury Secretary Steven Mnuchin and "Shark Tank" star Kevin O’Leary have also expressed interest in buying TikTok.

An initial public offering or a spin-off are two other potential outcomes, Ives said.

What about the TikTok algorithm?

Another key challenge is TikTok’s algorithm that recommends videos to users. The bill prohibits ByteDance from controlling the algorithm. China has cracked down on Chinese tech companies exporting those technologies.

Ives said China and ByteDance "will never allow the source code to be sold to a U.S. tech company in our view."

In addition, "detaching the algorithm from ByteDance would be a very complex process with much scrutiny from U.S. regulators," he said.

How would a TikTok ban work?

If signed into law, the bill would prevent app stores like Apple and Google from distributing or updating TikTok and web hosting companies from distributing it.

Banning the app won’t necessarily stop TikTok fans from using it. In 2020 when India banned TikTok after an incident at the Chinese border, TikTok users found workarounds to circumvent the ban.

Those strategies include using a VPN or changing your location on your phone to fool the app stores. Another option is "side-loading" − downloading and installing a bootleg version of the TikTok app from the internet − but it carries the risk of downloading malware.

Who would benefit from a TikTok ban?

YouTube, Facebook and Instagram would benefit most from a TikTok ban. Snapchat and Pinterest could also draw users and advertising dollars from TikTok, analysts say.

YouTube continues to be the No. 1 app with teens . Nine in 10 teens use the app, followed by TikTok (63%), Snapchat (60%) and Instagram (59%), according to Pew Research Center. Teens are less likely to use Facebook and X (formerly Twitter) than they were a decade ago.

X owner Elon Musk conducted a poll on the social media platform, hinting he might bring back mobile video app Vine .  Musk said Friday that he opposed banning TikTok.

"In my opinion, TikTok should not be banned in the USA, even though such a ban may benefit the X platform," he wrote on X. "Doing so would be contrary to freedom of speech and expression. It is not what America stands for."

What do Americans think about a TikTok ban?

The American public remains divided. 

Nearly half of the respondents in a CNBC All-America Economic Survey poll taken in March say TikTok should be banned or sold to a non-Chinese company.

Forty percent of Democrats and 60% of Republicans support a ban or a sale of the popular app, the survey found.

This is how the  MLB.com glossary  explains the process: "When a player's contract is designated for assignment — often abbreviated "DFA" — that player is immediately removed from his club's 40-man roster. Within seven days of the transaction (had been 10 days under the 2012-16 Collective Bargaining Agreement), the player can either be traded or placed on irrevocable outright waivers."

The Diamondbacks' decision to designate Ahmed for assignment is fairly routine when a team is looking to remove an underachieving veteran player from the 40-man roster. These types of players are not part of the franchise's future plans, so they would not be candidates to option to the minor leagues. Also, since the trading deadline passed in August, using waivers is the only option available for a player to move to another team.

As Arizona Republic Diamondbacks insider Nick Piecoro reported, Ahmed was not the same player, offensively or defensively , since diving for a ball during an exhibition in July 2020 while preparing for the start of the pandemic-shortened season. Since the team was likely to give top prospect Jordan Lawlar a shot at the starting shortstop job next year, cutting ties with Ahmed was not that much of a surprise.

Bird Flu Is Infecting More Mammals. What Does That Mean for Us?

H5N1, an avian flu virus, has killed tens of thousands of marine mammals, and infiltrated American livestock for the first time. Scientists are working quickly to assess how it is evolving and how much of a risk it poses to humans.

In her three decades of working with elephant seals, Dr. Marcela Uhart had never seen anything like the scene on the beaches of Argentina’s Valdés Peninsula last October.

It was peak breeding season; the beach should have been teeming with harems of fertile females and enormous males battling one another for dominance. Instead, it was “just carcass upon carcass upon carcass,” recalled Dr. Uhart, who directs the Latin American wildlife health program at the University of California, Davis.

H5N1, one of the many viruses that cause bird flu, had already killed at least 24,000 South American sea lions along the continent’s coasts in less than a year. Now it had come for elephant seals.

Pups of all ages, from newborns to the fully weaned, lay dead or dying at the high-tide line. Sick pups lay listless, foam oozing from their mouths and noses.

Dr. Uhart called it “an image from hell.”

In the weeks that followed, she and a colleague — protected head to toe with gloves, gowns and masks, and periodically dousing themselves with bleach — carefully documented the devastation. Team members stood atop the nearby cliffs, assessing the toll with drones.

What they found was staggering: The virus had killed an estimated 17,400 seal pups , more than 95 percent of the colony’s young animals.

The catastrophe was the latest in a bird flu epidemic that has whipped around the world since 2020, prompting authorities on multiple continents to kill poultry and other birds by the millions. In the United States alone, more than 90 million birds have been culled in a futile attempt to deter the virus.

There has been no stopping H5N1. Avian flu viruses tend to be picky about their hosts, typically sticking to one kind of wild bird. But this one has rapidly infiltrated an astonishingly wide array of birds and animals, from squirrels and skunks to bottlenose dolphins, polar bears and, most recently, dairy cows.

“In my flu career, we have not seen a virus that expands its host range quite like this,” said Troy Sutton, a virologist who studies avian and human influenza viruses at Penn State University.

Dec. 2021 The H5N1 bird flu virus is detected on a farm in St. John’s, Newfoundland, and in a sick wild gull nearby. Hundreds of birds on the farm died, and the rest were culled. It is the first detection of the virus in North America.

Migrating shorebirds may have carried the virus from Europe to Newfoundland through Iceland or Greenland. Or seabirds that congregate in the north Atlantic Ocean might have carried the virus ashore when they returned to Newfoundland to breed.

Jan. 2022 The virus is first detected in the United States, in wild birds in North and South Carolina.

Summer 2022 Hundreds of harbor seals and gray seals die along the coast of Maine and along the St. Lawrence Estuary in Quebec. The seals may have been infected by living near or eating sick and dead birds.

Fall 2022 After months moving west across the United States and Canada, the virus spreads south into Mexico and Colombia , most likely by migrating birds carrying it down the Pacific Flyway.

Nov. 2022 The virus reaches Peru, causes a mass die-off of pelicans along the coast, and begins to spread to other birds and marine mammals. Confirmed samples are shown as dots.

Early 2023 Thousands of sea lions die in Peru and Chile, the earliest known mass sea lion deaths from the virus. The virus continues spreading down the Chilean coast towards Cape Horn.

Late 2023 The virus rounds Cape Horn and moves north into Argentina and Uruguay, killing sea lions and seals and eventually reaching southern Brazil.

Oct. 2023 The virus also spreads south , entering the Antarctic region for the first time. Birds on the island of South Georgia are infected, followed in January by elephant seals and fur seals . Seabirds on the Falklands Islands are also infected.

The blow to sea mammals, and to dairy and poultry industries, is worrying enough. But a bigger concern, experts said, is what these developments portend: The virus is adapting to mammals, edging closer to spreading among people.

A human pandemic is by no means inevitable. So far at least, the changes in the virus do not signal that H5N1 can cause a pandemic, Dr. Sutton said.

Still, he said, “We really don’t know how to interpret this or what it means.”

Marine mortalities

A highly pathogenic strain of H5N1 was identified in 1996 in domestic waterfowl in China. The next year, 18 people in Hong Kong became infected with the virus, and six died. The virus then went silent, but it resurfaced in Hong Kong in 2003. Since then, it has caused dozens of outbreaks in poultry and affected more than 800 people who were in close contact with the birds.

All the while, it continued to evolve.

The version of H5N1 currently racing across the world emerged in Europe in 2020 and spread quickly to Africa and Asia. It killed scores of farmed birds, but unlike its predecessors it also spread widely among wild birds and into many other animals.

Most infections of mammals were probably “dead-end” cases: a fox, perhaps, that ate an infected bird and died without passing on the virus. But a few larger outbreaks suggested that H5N1 was capable of more.

The first clue came in the summer of 2022, when the virus killed hundreds of seals in New England and Quebec . A few months later, it infiltrated a mink farm in Spain .

In the mink, at least, the most likely explanation was that H5N1 had adapted to spread among the animals. The scale of the outbreaks in sea mammals in South America underscored that probability.

“Even intuitively, I would think that mammal-to-mammal transmission is very likely,” said Malik Peiris, a virologist and expert in bird flu at the University of Hong Kong.

After it was first detected in South America, in birds in Colombia in October 2022, the virus swept down the Pacific coast to Tierra del Fuego, the southernmost tip of the continent, and up the Atlantic coast.

Along the way, it killed hundreds of thousands of seabirds, and tens of thousands of sea lions, in Peru , Chile , Argentina, Uruguay and Brazil. The sea lions behaved erratically, experiencing convulsions and paralysis; pregnant females miscarried their fetuses .

“What happened when the virus moved to South America we had never seen before,” Dr. Uhart said.

Exactly how and when the virus jumped to marine mammals is unclear, but the sea lions most likely came into close contact with infected birds or contaminated droppings. (Although fish make up the bulk of sea lions’ diet, they do sometimes eat birds.)

At some point, it’s likely the virus evolved to spread directly among the marine mammals: In Argentina, the sea lion deaths did not coincide with the mass mortality of wild birds.

“This could suggest that the infection source was not the infected birds,” said Dr. Pablo Plaza, a wildlife veterinarian at the National University of Comahue and National Scientific and Technical Research Council in Argentina.

It is not hard to imagine how the virus might disperse in these animals: Elephant seals and sea lions both breed in colonies, crowding together on beaches where they fight, mate and bark at one another. Elephant seals sneeze all day, dispersing large droplets of mucus each time they do.

It is difficult to prove exactly how and when the virus moved from one species to another. But genetic analysis supports the theory the marine mammals acquired their infections from one another, not birds. Samples of virus isolated from sea lions in Peru and Chile and from the elephant seals in Argentina all share about 15 mutations not seen in the birds; the same mutations were also present in a Chilean man who was infected last year.

There are numerous opportunities for H5N1 to jump from sea mammals into people. One sick male elephant seal that sat for a day and a half on a public beach in Argentina turned out to carry enormous amounts of virus. In Peru, scientists collected samples from sea lion carcasses that lay alongside families enjoying a beach day.

Scavenging animals, such as dogs, could also pick up the virus from an infected carcass and then spread it more broadly: “None of the wildlife exists in their little silos,” said Wendy Puryear, a virologist at Tufts University who studied the New England seal outbreaks.

In some South American countries, apart from a few carcasses that were buried, the rest have remained on the beaches, rotting and scavenged upon.

“How do you even scale up to remove 17,000 dead bodies out in the middle of nowhere, places where you can’t even bring down machinery, and humongous cliffs?” Dr. Uhart said.

A mutating pathogen

Flu viruses are adept at picking up new mutations; when two types of flu virus infect the same animal, they can shuffle their genetic material and generate new versions.

It is unclear exactly how, and how much, the H5N1 virus has changed since it first emerged. One study last year showed that after the virus entered the United States, it quickly mixed with other flu viruses circulating here and morphed into various versions — some mild, others causing severe neurological symptoms.

“So now after 20 years of reassortment, you have a virus that actually does extraordinary well in a whole variety of avian and mammal species,” said Vincent Munster, a virologist at the National Institute of Allergy and Infectious Diseases who has studied the mutations needed for H5N1 to adapt to people.

Every new species that harbors the virus creates opportunities for H5N1 to continue to evolve, and to jump into people.

And the virus may stumble across mutations that no one has yet considered, allowing it to breach the species barrier. That is what happened in the 2009 swine flu outbreak.

That virus did not have the mutations thought to be needed to infect people easily. Instead, “it had these other mutations that no one knew about or thought about before then,” said Louise Moncla, an evolutionary biologist who studies avian influenza at the University of Pennsylvania.

Still, even if the virus jumps to people, “we may not see the level of mortality that we’re really concerned about,” said Seema Lakdawala, a virologist at Emory University. “Preexisting immunity to seasonal flu strains will provide some protection from severe disease.”

What happens next

The U.S. is prepared for an influenza pandemic, with some stockpiled vaccines and antivirals, but its efforts at monitoring the virus may not pick it up quickly enough to deploy those tools.

It took several weeks before farmers, and then officials, knew that H5N1 was circulating in dairy cows.

The dairy farm outbreak has resulted in only one mild human infection, but farms are fertile ground for the virus to jump species — from cat to cow to pig and human, in any order.

Many scientists worry in particular about pigs, which are susceptible to both human and avian flu strains, providing the perfect mixing bowl for viruses to swap genes. Pigs are slaughtered when very young, and newer generations, with no prior exposure to flu, are particularly vulnerable to infections.

So far, H5N1 does not seem adept at infecting pigs, but that could change as it acquires new mutations.

“I never let my kids go to a state fair or animal farm, I’m one of those parents,” Dr. Lakdawala said. “And it’s mostly because I know that the number of interactions that we increase with animals, the more opportunities there are.”

Should H5N1 adapt to people, federal officials will need to work together and with their international counterparts. Nationalism, competition and bureaucracy can all slow down the exchange of information that is crucial in a developing outbreak.

In some ways, the current spread among dairy cows is an opportunity to practice the drill, said Rick Bright, the chief executive of Bright Global Health, a consulting company that focuses on improving responses to public health emergencies. But the U.S. Agriculture Department is requiring only voluntary testing of cows, and is not as timely and transparent with its findings as it should be, he said.

Dr. Rosemary Sifford, the department’s chief veterinarian, said the staff there were working hard to share information as quickly as they can. “This is considered an emerging disease,” she said.

Government leaders are typically cautious, wanting to see more data. But “given the rapid speed at which this can spread and the devastating illness that it can cause if our leaders are hesitant and don’t pull the right triggers at the right time, we will be caught flat-footed once again,” Dr. Bright said.

“If we don’t give it the panic but we give it the respect and due diligence,” he added, alluding to the virus, “I believe we can manage it.”
