ಏಕರೂಪ ನಾಗರೀಕ ಸಂಹಿತೆಯ ಅರ್ಥವೆಂದರೆ ಸದ್ಯ ದೇಶದಲ್ಲಿ ಎಲ್ಲರಿಗೂ ಸಮಾನವಾದ ಹಕ್ಕುಗಳು ಮತ್ತು ಸಾರ್ವಜನಿಕ ಜೀವನದಲ್ಲಿ ಪಾಲಿಸಬೇಕಾದ ಸಮಾನ ತಾಣುಗಳಿವೆ. ಆದರೆ ಮದುವೆ, ವಿಚ್ಛೇದನ, ಆಸ್ತಿ ಹಂಚಿಕೆ ವಾರಸುದಾರಿಕೆ ಮುಂತಾದ ವೈಯಕ್ತಿಕ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧ ಪಟ್ಟಂತೆ ಆಯಾ ಧಾರ್ಮಿಕ ಕಟ್ಟು ಪಾಡು ಮತ್ತು ನೀತಿಯಂತೆ ಬೇರೆ ಬೇರೆ ವೈಯಕ್ತಿಕ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ಆಯಾ ಧಾರ್ಮಿಕ ಕಟ್ಟು ಪಾಡು ಮತ್ತು ನೀತಿಯಂತೆ ಬೇರೆ ಬೇರೆ ವೈಯಕ್ತಿಕ ಕಾರಣಗಳಿವೆ. ಹೀಗೆ ಪ್ರತ್ಯೇಕ ಧರ್ಮ ನಂಬಿಕೆಗೆ ಅನುಗುಣವಾಗಿ ಇರುವ ಕಾನೂನುಗಳು ಕೆಲವು ವಿಷಯಗಳಲ್ಲಿ ಶಕದ ಸಾಂವಿಧಾನಿಕ ಹಕ್ಕುಗಳಿಗೆ ವಿರುದ್ಧವಾಗಿದೆ. ಆ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ದೇಶದೊಳಗಿನ ಎಲ್ಲಾ ನಾಗರಿಕರಿಗೆ ಅವರ ಧರ್ಮ ನಂಬಿಕೆಗಳನ್ನು ಹೊರತು ಪಡಿಸಿದ ಸಮಾನವಾದ ಕಾನೂನುಗಳು ಇರಬೇಕು ಎಂಬ ಆಶಯದ ಪರಿಕಲ್ಪನೆಯೇ “ಸಮಾನ ನಾಗರೀಕ

ಕಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆಯ ಉದ್ದೇಶವೆಂದರೆ ಆಸ್ತಿಪಾಸ್ತಿ, ಮದುವೆ, ದಾಂಪತ್ಯ, ಅವಿವಾಹ ವಿಚ್ಚೇದನ ಉತ್ತರಾಧಿಕಾರ ದತ್ತು ಸ್ವೀಕಾರ ಮುಂತಾದ ವಿಚಾರಗಳಲ್ಲಿ ಎಲ್ಲ ಧರ್ಮಗಳಿಗೂ ಸೇರಿದ ಮಹಿಳೆಯರಿಗೂ ಮತ್ತು ಪುರುಷರಿಗೂ ಸಮಾನವಾದ ಹಕ್ಕು ದೊರಕಿಸುವುದ ಇದರ ಮೂಲ ಉದ್ದೇಶ.

ವಸ್ತು ನಿಷ್ಠವಾಗಿ ನೋಡಿದರೆ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಎನ್ನುವುದು ಯವುದೇ ಧರ್ಮದಲ್ಲಿ ಇರುವ ಅಸಮಾನತೆಯನ್ನು ಅದರಲ್ಲೂ ಮಹಿಳೆಯರನ್ನು ಬಾಧಿಸುವ ಅಸಮಾನತೆಯನ್ನು ನಿವಾರಿಸಲು ನೆರವಾಗುವ ಕಾನೂನಾಗಿದೆ.

ಪ್ರಚಲಿತದಲ್ಲಿ ಜಾರಿಗೆ ತರುವ ಚರ್ಚೆಗೆ ಕಾರಣ/ ಹಿನ್ನಲೆ

ಸಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆಯ ಮೇಲಿನ ಈ ಚರ್ಚೆಯು ಬ್ರಿಟಿಷರ ಕಾಲದಿಂದಲೂ ಚರ್ಚೆಯಲ್ಲಿದೆ 1840ರ ‘ಲೆಪ್ಪಲೋಸಿ’ ವರದಿಯು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿತ್ತು. ಆದರೆ ಧಾರ್ಮಿಕ ಆಚರಣೆಗಳಿಂದ ಪ್ರೇರೇಪಿತವಾಗಿರುವ ಕಾನೂನುಗಳನ್ನು ಬದಲಿಸುವ ದುಸ್ಸಾಹಸವನ್ನು ಬ್ರಿಟಿಷರು ಮಾಡಲಿಲ್ಲ. ನಮ್ಮ ಸಂವಿಧಾನದ 44ನೇ ಪರಿಚ್ಛೇದದ ನಿರ್ದೇಶನದಂತೆ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯ ರಚನೆಯು ಕೇಂದ್ರ ಸರ್ಕಾರ ನಿರ್ವಹಿಸಬೇಕಾದ ಒಂದು ಮಹತ್ವದ ಅಂಶವಾಗಿದೆ, ಅನೇಕ ಸಲ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಮತ್ತು ಹೈಕೋರ್ಟುಗಳು ಅಧಿಕಾರಸ್ಥೆ ಸರಕಾರಗಳಿಗೆ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯನ್ನು ರಚಿಸುವಂತೆ ಸಲಹೆಗಳನ್ನು ನೀಡಿವೆ. ಕಳೆದ ಏಳು ದಶಕಗಳಿಂದ ಆ ವಿಷಯ ನೆಪಥ್ಯಕ್ಕೆ ಸೇರಿತ್ತು.

1956ರಲ್ಲಿ ಭಾರತಿ ವಿರೋಧದ ನಡುವೆಯು ಸಂಸತ್ತಿನಲ್ಲಿ ಒಂದುಕೋಡ್ ವಿಧೇಯಕವನ್ನು ಪಾಸುಮಾಡಲಾಯಿತು. 1985ರಲ್ಲಿ ಉತ್ತರಾಖಂಡ ಮೂಲದ “ತಾಯಿದಾವಾನು” ಎಂಬ ಮಹಿಳೆಯ ತಲಾಖ್ ಪ್ರಕರಣದ ವಿಚಾರಣೆಯಲ್ಲಿ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯ ಕುರಿತು ನಿಲುವನ್ನು ಸ್ಪಷ್ಟ ಪಡಿಸುವಂತೆ ನಿರ್ಧರಿಸಿದ ನಂತರ ಕೇಂದ್ರ ಸರ್ಕಾರವು ಈ ವಿಷಯವನ್ನು ಸಮಗ್ರವಾಗಿ ಪರಿಶೀಲಿಸಿ ವರದಿ ನೀಡಲು. ಕಾನೂನು ಆಯೋಗಕ್ಕೆ ಸೂಚಿಸಿತು. ಕಾನೂನು ಆಯೋಗ ಈ ವಿಷಯ ಕುರಿತಂತೆ ಜಾಲಿ ಬಾಯ ಸಂಗ್ರಹಿಸಲು ಸಮೀಕ್ಷೆಗೆ ಮುಂದಾಯಿತು. ಆ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಸಮಾನ ನಗರೀಕ ಸಂಹಿತೆ ವಿಷಯ ಪ್ರಚಲಿತದಲ್ಲಿ ರಾಜ್ಯಾದ್ಯಂತ ಚರ್ಚೆಯಲ್ಲಿದೆ.

ಈ ಕಾನೂನಿನ ಅಗತ್ಯತೆ ನಮ್ಮ ಹಲವು ಧರ್ಮಗಳು ಮತ್ತು ನಿಂದು. ಜಾತಿಗಳಿವೆ, ವಿವಾಹ ವಿಚ್ಛೇದನ ಉತ್ತರಾಧಿಕಾರ ಮತ್ತು ಆಸ್ತಿಗೆ ಸಂಬಂದಿಸಿದಂತೆ ಹಿಂದೂ- ಕ್ರಿಶ್ಚಿಯನ್ ವೈಯಕ್ತಿಕ ಕಾನೂನುಗಳು ಒಂದು ರೀತಿ ಹೇಳಿದರೆ ಮುಸ್ಲಿಂ ವೈಯಕ್ತಿಕ ಕಾನೂನು ಇನ್ನೊಂದು ರೀತಿ ಹೇಳುತ್ತದೆ. ಎಲ್ಲ ಧರ್ಮಗಳು ವೈಯಕ್ತಿಕ ಕಾನೂನುಗಳು ಲೋಪದಿಮದ ಕೂಡಿವೆ ಇದರಿಂದ ಮಹಿಳೆಯರಿಗೆ ಹೇಳಲೇರದಷ್ಟು ಅನ್ಯಾಯವಾಗುತ್ತಿದೆ. ಈ ಅನ್ಯಾಯವು ಕೊನೆಗೊಳ್ಳಬೇಕಾಗಿದೆ. ನಾಗರೀಕ ಸಮಾಜದಲ್ಲಿ ಬಾಳುತ್ತಿರುವ ನಾವು ಧರ್ಮಕ್ಕಿಂತ ಮಾನವಿಯತೆ ದೊಡ್ಡದು ಎಂಬುದನ್ನೇ ಅರಿತು ಒಪ್ಪಿಕೊಳ್ಳಲು ಈಗ ಸಕಾಲ ಸಂವಿಧಾನದ ಘೋಷ ವಾಕ್ಯವೇ “ಜಾತ್ಯಾತೀತ ತತ್ವ’ ಆದ್ದರಿಂದ ಜಾತಿ ಧರ್ಮದ ಹೆಸರಲ್ಲಿ ಬೇದ ಭಾವಗಳನ್ನು ನಾವೇಕೆ ಘೋಷಿಸಬೇಕು? ನಮ್ಮ ವ್ಯಕ್ತಿಗತ ಧರ್ಮಗಳಿಗಿಂತ ಸಂವಿಧಾನವೇ ದೊಡ್ಡದು ಎಂಬುದನ್ನು ಸಾಧಿಸಬೇಕಾದ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಅಗತ್ಯವಾಗಿದೆ.

ಭಾರತದ ಸಾಮಾಜಿಕ ಧಾರ್ಮಿಕ ಮತ್ತು ಸಾಂಸ್ಕೃತಿಕ ಬಿನ್ನತೆ ಬಹುರೂಪದಷ್ಟೇ ಅಲ್ಲ. ವಿರಾಟರೂಪದಲ್ಲಿಯೂ ಇದೆ. ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಎಲ್ಲರಿಗೂ ಸಮಾನವಾಗಿ ಅನ್ವಯಿಸುವ ಕಾನೂನುಗಳನ್ನು ರಚಿಸುವುದೇ ಸ್ವತಂತ್ರ ಭಾರತ ಎದುರಿಸಿದ ಅತ್ಯಂತ ಸಂಕಿರ್ಣ ಸವಾಲಾಗಿದೆ. ಈ ಸವಾಲನ್ನು ಈ ಸ್ವೀಕರಿಸಿ ಪರಿಹರಿಸುವ ಮಹತ್ವ ಪೂರ್ಣ ಜವಾಬ್ದಾರಿಯನ್ನು ನಿಭಾಯಿಸುವ ಅಗತ್ಯ ಇದೆ.

ನಮ್ಮ ಭಾರತದ ಸಂವಿಧಾನವು ಹೇಳುವುದೇನೆಂದರೆ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯು ಪ್ರಸ್ತಾಪ ಇರುವುದು ಸಂವಿಧಾನದ 44ನೇ ವಿಧಿಯಲ್ಲಿ ಆದರೆ ಇದು ಕಡ್ಡಾಯವಲ್ಲ. ರಾಜ್ಯ ನಿರ್ದೇಶಕ ತತ್ವಗಳಲ್ಲಿ ಈ ವಿಷಯವನ್ನು ಸೇರಿಸಲಾಗಿದೆ. ಸಂವಿಧಾನವು ಹೇಳುವುದಷ್ಟೇ.

ಭಾರತದ ಎಲ್ಲ ಪ್ರದೇಶಗಳಲ್ಲಿ ತನ್ನೆಲ್ಲಾ ಜನರಿಗೆ ಸಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆಯನ್ನು ರೂಪಿಸಲು ಸರ್ಕಾರ ಪ್ರಯತ್ನಿಸಬೇಕು’ ಇದೇ ವೇಳೆ ಸಂವಿಧಾನದ 37ನೇ ವಿಧಿಯು ರಾಜ್ಯ ನಿರ್ದೇಶಕ ತತ್ವಗಳನ್ನೇ ಕೋರ್ಟಿ ಮೂಲಕ ಸ್ಪಷ್ಟ ಅಭಿಪ್ರಾಯವನ್ನು ಹೊಂದಿದೆ. ರಾಜ್ಯ ನಿರ್ದೇಶಕ ತತ್ವಗಳನ್ನು ಜಾರಿ ಮಾಡಲು ಅವಕಾಶವಿಲ್ಲ. ಹಾಗಾಗಿ ಈ ವಿಷಯದಲ್ಲಿ ಸಂಸತ್ತು ಒಮ್ಮತದ ನಿರ್ಣಯಕ್ಕೆ ಒಂದು ಸಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆಯನ್ನು ಜಾರಿಗೊಳಿಸಬೇಕಾದ ಅಗತ್ಯವಿದೆ.

ಅಗತ್ಯತೆಯನ್ನು ಪುಷ್ಟಿಕರಿಸುವ ಅಂಶಗಳ ಎಂದರೆ ಅವುಗಳು: ಏಕರೂಪ ನಾಗರೀಕ ಸಂಹಿತೆ

ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯನ್ನು ಜಾರಿಗೆ ತರುವುದರಿಂದ ಸಮಾಜದಲ್ಲಿ ಲಿಂಗ ತಾರತಮ್ಯ ಹಾಗೂ ತಲಾಬ್‌ನಂತಹ ಅನಿಷ್ಠ ಪದ್ಧತಿಗಳಿಗೆ ತಿಲಾಂಜಲಿ ಹಾಡಬಹುದು.

ಈ ನೀತಿ ಸಂಹಿತೆಯು ಸರ್ವ ಧರ್ಮ ಸಮಾನತೆಯನ್ನುಂಟು ಮಾಡುತ್ತದೆ. ಪ್ರಸ್ತುತ ಎಲ್ಲ ಧರ್ಮಗಳಲ್ಲಿರುವ ಅಪಸವ್ಯಗಳನ್ನು ತೊಡೆದು ಹಾಕಬಹುದು. ಬ್ರಿಟಿಷರು ತಮ್ಮ ರಾಜಕೀಯದ ಬೇಳೆ ಬೆಯಿಸಿಕೊಳ್ಳಲು ಬೇರೆ ಬೇರೆ ಧರ್ಮದವರಿಗೆ

ಬೇರೆ ಬೇರೆ ಕಾನೂನುಗಳನ್ನು ರಚಿಸಿದನ್ನೇ ರದ್ದು ಗೊಳಿಸಲು ಹಾಗೂ ಪ್ರತಿಯೊಬ್ಬ ಭಾರತೀಯನ ಪ್ರಜೆಗೂ ಕೂಡಾ ಒಂದೇ ಕಾನೂನು ಅನ್ವಯವಾಗುವಂತೆ ಮಾಡುವುದು.

ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯು ಮಹಿಳೆಯರಿಗೆ ಈಗಿರುವ ಸೌಲಭ್ಯಗಳಿಗಿಂತ ಹೆಚ್ಚಿನ ಹಕ್ಕುಗಳನ್ನು ನೀಡುತ್ತದೆ.

ಎಲ್ಲ ಧರ್ಮ ಹಾಗೂ ಮತಗಳಲ್ಲಿನ ಇಂದಿನ ನಾಗರೀಕ ಸಾಮಾಜಕ್ಕೆ ಪ್ರಸ್ತುತವೇನಿಸುವ ಎಲ್ಲಾ ಒಳ್ಳೆಯ ಅಂಶಗಳನ್ನು ಕಲೆ ಹಾಕಿದ ಸಮಾನ ಸಂಹಿತೆಯನ್ನು ಸ್ವೀಕರಿಸಬೇಕಿದೆ.

ಮಾನವೀಯತೆಯನ್ನು ಮೀರಿದ ಧರ್ಮ ಯಾವುದಿದೆ? ಯಾವುದೇ ಧರ್ಮದಲ್ಲಿ ಅಮಾನವೀಯ ಅಂಶಗಳು ಆಚರಣೆಯಲ್ಲಿದ್ದರೆ ಪ್ರಸ್ತುತ ಸಮಾಜವು ಮುಖ್ಯ ಪ್ರೇಕ್ಷಕನಾಗಬೇಕೇ?

ಭಾರತೀಯ ಸಂವಿಧಾನವು ತನ್ನ ಪೀಠಿಕೆ ಹಾಗೂ 14,15, 20 ಮತ್ತು 20ನೇ ವಿಧಿಗಳ ಮೂಲಕ ತನ್ನ ನಾಗರಿಕರು ಸಮಾನ ಹಕ್ಕುಗಳಿಗೆ ಅರ್ಹರು ಎಂದು ಆದೇಶಿಸಿ ಧರ್ಮಾಧಾರಿತ ಅಸಮಾನತೆಯನ್ನು ತಿರಸ್ಕರಿಸಿದೆ ಅಲ್ಲವೆ?

ಸ್ವಾತಂತ್ರ್ಯಸಿಕ್ಕ ಮೊದಲ ಕೆಲವು ದಶಕಗಳ ಕಾಲ ಬೇರೆ ಬೇರೆ ಕ್ಷೇತ್ರಗಳಲ್ಲಿ ತನ್ನನ್ನು ತಾನು ಸ್ವೀಕರಿಸಿಕೊಳ್ಳಬೇಕಿರುವುದರಿಂದ ಸಂವಿಧಾನದ 44ನೇ ವಿಧಿಯಿಂದ ರಾಜ್ಯ ನಿರ್ದೇಶಕ ತತ್ವಗಳಡಿಯಲ್ಲಿ ಈ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯನ್ನು ಒಮ್ಮೆಲೇ ಅಲ್ಲದಿದ್ದರೂ ಕೆಲಕಾಲದ ನಂತರ ತರಬೇಕಾದ ಅನಿವಾರ್ಯತೆಯನ್ನು ತಿಳಿಸಲಾಗಿದೆ.

ವೈಯಕ್ತಿಕ ಕಾನೂನುಗಳನ್ನು ಒಂದೇ ಧರ್ಮಕ್ಕೆ ಸೀಮಿತ ಮಾಡಿಲ್ಲ ಅವು ಎಲ್ಲ ಧರ್ಮಗಳಲ್ಲೂ ಇವೆ. ವೈಯಕ್ತಿಕ ಕಾನೂನುಗಳು ಸಂವಿಧಾನದ ಆಶಯಕ್ಕೆ ದಕ್ಕೆ ತಾರದಿದ್ದರೆ ಅವುಗಳನ್ನು ಹಾಗೆ ಉಳಿಸಿಕೊಳ್ಳಬಹುದು ಒಂದು ವೇಳೆ ಅವು ಸಂವಿಧಾನದ ಆಶಯಕ್ಕೆ ದಕ್ಕೆಯನ್ನು ತರುವಂತಿದ್ದರೆ ಅಂತಹ ಕಾನೂನುಗಳನ್ನು ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಡಿಸಲೇಬೇಕು.

ಭಾರತೀಯರ ಧಾರ್ಮಿಕ ವಿಚಾರದಲ್ಲಿ ಮೂಗು ತೂರಿಸುವ ಅಧಿಕಾರ ಪ್ರಭುತ್ವಕ್ಕೆ ಇಲ್ಲ ಎಂಬುದು ನಿಜ ಆದರೆ ದೇಶವಾಸಿಗಳ ಬದುಕಿನ ಜಾತ್ಯಾತೀತ ಚಟುವಟಿಕೆಗಳ ಬಗ್ಗೆ ಕಾನೂನು ರೂಪಿಸುವ ಅಧಿಕಾರ ಪ್ರಭುತ್ವಕ್ಕೆ ಇರುತ್ತದೆ.

ಒಂದು ದೇಶವು ತನ್ನ ಮಹಿಳೆಯರನ್ನು ಸಂರಕ್ಷಿಸಿ ಅವರಿಗೆ ಕ್ರಿಯಾಶೀಲ ಮತ್ತು ಮುಕ್ತ ಜೀವನ ನಡೆಸಲು ಬೇಕಾದ ಸಂಪೂರ್ಣ ಸ್ವಾತಂತ್ರ್ಯ ಮತ್ತು ಅವಕಾಶಗಳನ್ನು ಒದಗಿಸಬೇಕು.

ದೇಶದಲ್ಲಿಯೇ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯನ್ನು ಜಾರಿಗೊಳಿಸಿದ ಏಕೈಕ ರಾಜ್ಯ ಗೋವಾ ಅದೇ ರೀತಿ ಉಳಿದ ಎಲ್ಲ ರಾಜ್ಯಗಳಿಗೂ ಅದನ್ನು ವಿಸ್ತರಿಸಬೇಕಿದೆ. ಅಗತ್ಯವಿದ್ದಲ್ಲಿ ಸೂಕ್ತ ಮಾರ್ಪಾಡುಗಳನ್ನು ಮಾಡಬಹುದಲ್ಲವೆ?

ಜಾರಿಗೊಳಿಸಲು ಇರುವ ಅಡ್ಡಿ ಆತಂಕಗಳು

ಈ ಸಂಹಿತೆಯನ್ನು ವಿರೋಧಿಸಲು ಕೆಲವು ಸಂಘಟನೆಗಳು ಹಲವಾರು ಸುಳ್ಳುಗಳನ್ನು ತೇಲಿ ಬಿಡಲಾಗುತ್ತಿದೆ. ಈ ಮೂಲಕ ಮಹಿಳೆಯರನ್ನು ಹಾದಿ ತಪ್ಪಿಸಲಾಗುತ್ತಿದೆ, ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಜಾರಿಗೆ ತರಲು ಅಡ್ಡಿಯಾಗಿರುವ ಎರಡು ಪ್ರಮುಖ ಅಂಶಗಳೆಂದರೆ ಒಂದು ರಾಜಕಾರಣ ಇನ್ನೊಂದು ಧರ್ಮಕಾರಣ .

ಧಾರ್ಮಿಕತೆಗೆ ದಕ್ಕೆ ಬರುವ ಸೂಕ್ಷ್ಮತೆ ಭಾರತದ ಧರ್ಮಾಂದರ ಕುಟೀಲತೆ.

ಇದು ಅತ್ಯಂತ ಸೂಕ್ಷ್ಮವಾಗಿರುವ ರಾಷ್ಟ್ರೀಯ ವಿಚಾರವಾಗಿರುವುದರಿಂದ ಆತುರಾತುರವಾಗಿ ಜಾರಿ ಮಾಡಲು ಸಾಧ್ಯವಿಲ್ಲ. ತ್ರಿವಳಿ ತಲಾಖ್‌ ನಿಷೇಧವಾಗುವ ಲಕ್ಷಣಗಳಿರುವುದರಿಂದ ಇದಕ್ಕೆ ಅನೇಕ ಮುಸ್ಲಿಂ ಸಂಘಟನೆಗಳಿಂದ ತಿವ್ರತರ ವಿರೋಧವಿದೆ.

ಪರಿಹಾರ ಕ್ರಮಗಳು ಅಥವಾ ಚಿಂತನೆಗಳು

ಸಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆ ಜಾರಿ ಹಾಗೂ ತಲಾಖ್‌ ನಿಷೇಧ ಎರಡು ಒಂದೇ ಎನ್ನುವ ನಂಬಿಕೆ ಹಲವರಲ್ಲಿದೆ. ಆದರೆ ತಲಾಖ್ ಲಿಂಗಸಮಾನತೆಗೆ ಸಂಬಂಧಿಸಿದ ವಿಚಾರವಾದರೆ ಸಂಹಿತೆಯ ವಿವಿಧ ಜಾತಿ-ವರ್ಗಗಳ ಹಾಗೂ ಧರ್ಮಗಳ ನಡುವೆ ವಿವಾಹ ಆಸ್ತಿಹಕ್ಕು ಉತ್ತರಾಧಿಕಾರತ್ವದಲ್ಲಿ ಸಮಾನತೆ ತರುವ ವಿಚಾರವಾಗಿದೆ.

ಸಂಹಿತೆಯನ್ನು ವಿರೋಧಿಸುವವರಿಗೊಂದು ಹೇಳಬೇಕಾದ ಅದ್ಭುತ ವಿಷಯವೆಂದರೆ ನಮ್ಮ ದೇಶದಲ್ಲಿ ಗೋವಾ ರಾಜ್ಯದಲ್ಲಿ ಮಾತ್ರ ಈಗಾಗಲೇ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯನ್ನು ಜಾರಿಗೆ ತಂದಿದ್ದು ಅಲ್ಲಿರುವ ಎಲ್ಲ ಧರ್ಮಗಳ ಜನರೂ ಅದನ್ನು ಒಪ್ಪಿಕೊಂಡು ಜೀವನ ಮಾಡುತ್ತಿದ್ದಾರೆ.

ಈ ರೀತಿಯ ಸಂದಿಗ್ಧ ಪರಿಸ್ಥಿತಿಯನ್ನು ಎದುರಿಸಿ ಅದಕ್ಕೆ ಸೂಕ್ತ ಪರಿಹಾರ ಕಂಡುಕೊಂಡಿರುವ ಹಲವಾರು ರಾಷ್ಟ್ರಗಳಿವೆ. ಅವುಗಳು ಕೈಗೊಂಡಿರುವ ಪರಿಹಾರೋಪಾಯಗಳನ್ನು ಕೂಲಂಕುಷವಾಗಿ ಅಧ್ಯಯನ ಮಾಡಿ ನಮಗೆ ಸೂಕ್ತವೆನಿಸಿದ ವಿಷಯವನ್ನು ಕಂಡುಕೊಳ್ಳಬೇಕು.

ಧಾರ್ಮಿಕ ಸಮುದಾಯಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಬಹುತೇಕ ತೀರ್ಮಾನಗಳನ್ನು ಅಲ್ಲಿನ ಧಾರ್ಮಿಕ ಮುಖಂಡತ್ವವೇ ತೆಗೆದುಕೊಳ್ಳುತ್ತದೆ. ಆದರೆ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆಯ ಕುರಿತು ಆ ಸಮುದಾಯದ ಸಮಾಜ ವಿಜ್ಞಾನಿಗಳು ಮಾತನಾಡಬೇಕು. ಜನರನ್ನು ಧಾರ್ಮಿಕ ಹಿಡಿತದಿಂದ ಹೊರತರಬೇಕು.

ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಎಂಬುದು ಯಾವುದೇ ನಿರ್ದಿಷ್ಟ ಧರ್ಮದ ವಿರೋಧಿಯಲ್ಲ. ಈ ಬಗ್ಗೆ ಸರಿಯಾದ ತಿಳುವಳಿಕೆಗಳಿಲ್ಲದೆ ಕೆಲವರು ಮಾತನಾಡುತ್ತಿದ್ದಾರೆ. ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಕುರಿತಾದ ಚರ್ಚೆಯಲ್ಲಿ ಕೇವಲ ತಲಾಖ್ ಮತ್ತು ಬಹುಪತ್ನಿತ್ವದ ವಿಷಯಗಳನ್ನು ಕೇಂದ್ರೀಕರಿಸಿ ಹಾಕಲಾಗುತ್ತಿದೆ. ಇಂಥವರಿಗೆ ಸಂಹಿತೆಯ ಕುರಿತು ಸಂಪೂರ್ಣ ಮಾಹಿತಿಯನ್ನು ನೀಡಬೇಕಾದದ್ದು ಆದ್ಯ ಕರ್ತವ್ಯವಾಗಿದೆ.

ಹಿಂದೂ ಧರ್ಮದ ಪುರೋಹಿತರು ಸ್ವಾಮಿಗಳಾಗಲಿ ಇಸ್ಲಾಂ ನ ಮೌಲ್ವಿಗಳ ಮೌಲಾನಾಗಿರಲಿ, ಕ್ರೈಸ್ತ ಮತದ ಗುರುಗಳಾಗಿರಲಿ ರಾಷ್ಟ್ರದ ಪ್ರಜೆಗಳ ನಾಗರೀಕ ಹಕ್ಕುಗಳನ್ನು ಕಸಿದುಕೊಳ್ಳುವ ಹಾಗೂ ಯಾವುದೇ ವಿಧವಾದ ಅಸಮಾನತೆಯನ್ನು ಸೃಷ್ಟಿಸುವ ಅಧಿಕಾರವನ್ನು ಹೊಂದಿಲ್ಲ. ನಂಬಿಕೆ, ದೇವರ ಪೂಜೆ, ಮನಸ್ಕಾರಗಳು ವೈಯಕ್ತಿಕ. ಈ ವೈಯಕ್ತಿಕ ಸ್ವಾತಂತ್ರ್ಯವು ರಾಷ್ಟ್ರದ ನಾಗರೀಕರಲ್ಲಿ ಅಸಮಾನತೆಯನ್ನು ಸೃಷ್ಟಿಸುವಂತೆ ಮಾಡಲು ಎಲ್ಲರಿಗೂ ಭಾರತಿಯ ಸಂವಿಧಾನವನ್ನೇ ಪವಿತ್ರ ಗ್ರಂಥವಾಗಿ ಸ್ವೀಕರಿಸಬೇಕು. ರಾಜಕಾರಣಿಗಳು ತಮ್ಮ ವೈಯಕ್ತಿಕ ಸ್ವಾರ್ಥದ ಸಾಧನೆಯಲ್ಲಿ ರಾಷ್ಟ್ರದ ಹಿತವನ್ನು ಬಲಿಕೊಡಬಾರದು.

ಎಲ್ಲರೂ ಸಮಾನ ನಾಗರೀಕ ಸಂಹಿತೆ ಆಡಿಯಲ್ಲಿ ಬಂದಾಗ ನ್ಯಾಯದ ಮುಂದೆ ಎಲ್ಲರೂ ಸಮಾನರು. ಒಂದು ದೇಶವು ತನ್ನ ಮಹಿಳೆಯರನ್ನು ಸಂರಕ್ಷಿಸಿ ಅವರಿಗೆ ಕ್ರಿಯಾಶೀಲ ಮತ್ತು ಮುಕ್ತ ಜೀವನ ನಡೆಸಲು ಸಂಪೂರ್ಣ ಸ್ವಾತಂತ್ರ್ಯ ಸಿಗಬೇಕಿದೆ. ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಸುಪ್ರೀಂ ಕೋರ್ಟಿನ ಮಾರ್ಗದರ್ಶನದಲ್ಲಿ ಪ್ರಜಾಸತ್ತಾತ್ಮಕ ಜಗತ್ತಿನ ಅತ್ಯುತ್ತಮ ಅಂಶಗಳ ಜೊತೆಗೆ ತಮ್ಮದೇ ಕಾನೂನುಗಳ ಅಂಶಗಳನ್ನು ಸೇರಿಸಿಕೊಂಡು ಅತ್ಯುತ್ತಮವಾದ ಸಮಾನ ನಾಗರಿಕ ಸಂಹಿತೆಯನ್ನು ಸಂಸತ್ತಿನಲ್ಲಿ ಅಂಗೀಕರಿಸಬೇಕು.

ಯಾವುದೇ ರೀತಿಯಾದ ವಿನಾಯಿತಿ ಹಾಗೂ ಕಾಲಮಿತಿಯಿಲ್ಲದೇ ಎಲ್ಲ ರಾಜ್ಯಗಳು ಇದನ್ನು ಅನ್ವಯಿಸಿಕೊಳ್ಳಬೇಕು. ಇಂಥ ವಾತಾವರಣದಲ್ಲಿ ಮಾತ್ರ ಲಿಂಗ ಸಮಾನತೆ ಉಂಟಾಗಿ ಸರ್ವರನ್ನೊಳಗೊಂಡ ಸುಸ್ಥಿರ ಸಮಾಜ ನಿರ್ಮಾಣ ಮಾಡಲು ಸಾಧ್ಯ.
