In India, there is a custom of giving some gifts either in cash or gold or both before and after the wedding to the bride and the groom out of affection. It is considered as love and blessings for the newly wedded couple that help them in starting their new life. However, during the last three or four decades the Dowry System has become associated with the status of a family. Now, it has become compulsory to give money and gold to the groom’s family. This has given birth to the dowry system. In this essay on the Dowry System, we will highlight the points related to dowry in marriage and how it has affected our society. Moreover, at the end, we have discussed some steps to be taken to stop the dowry system.

Dowry System

Dowry has been conveniently defined as money, goods or estates, which a woman brings to her husband’s home after marriage. The system of dowry in marriages has been haunting our society for a long time. This is a social curse, which has gone unchecked, though time and again it has tormented people in general. Lust for money and acquiring high social status for one’s family has given birth to the social evil called Dowry. It has become the root cause of suicides and murders of brides. Bride burning for want of dowry has become a way of life. Different communities have different marriage customs, but the custom of giving dowry is shared by all the communities.

The dowry system is a great evil that still exists in society. It is an act of discrimination against unmarried girls, whose values are defined based on the prices of their respective dowries. It is an example of greed and selfishness and is a great curse, especially for the parents who belong to the lower middle class. This is the reason why people get depressed and feel cursed at the birth of a daughter. Moreover, the dowry system paves the way for other crimes against women like female foeticide, female infanticides, dowry death, cruelty by husband and his relatives.

How Can the Dowry System be Stopped?

A dowry system is a social stigma that needs to end. Every girl should go to her in-law’s house with pride. In India, every 5 out of 10 families face the dowry system. There are many laws made by the government but the custom of dowry persists in our society. So, there is an urgent need that we all start taking action against it. The first step is to start from our homes. At home, we should treat both boys and girls equally by providing them equal opportunities. We should educate both of them and give them freedom to be fully independent. The upbringing of the girls should not be limited to household work and marriage. In fact, they should be nourished in such a way that they feel free to make their choice, put their demands, ask questions, think openly and have the guts to fulfil their dreams.

There is a need to create awareness campaigns in different sections of society to make people aware of it. The campaign includes voluntary organization, civil marriage, launching of the youth movements etc. Eradicating the dowry practice will give equal rights to women and boost their confidence level. It will help in the growth of the family, society and nation. The sooner the dowry becomes a thing of the past, the better for our society.

Dowry system is followed in India since a very long time. Our ancestors started this system for valid reasons but now it is leading to issues and problems in society. In this essay on dowry, we will see what dowry exactly is, how it started, and why it should be stopped now.

History Of Dowry

Dowry system started even before the British period. In those days, society does not use to consider dowry as a “Money” or “Fee” you have to pay to be brides parents.

The idea behind the dowry system was, to make sure the bride will be financially stable after getting married. The intentions were very clear. Brides parents used to give money, land, assets to the bride as a “Gift” to make sure their daughter will be happy and independent after marriage.

But when British rule came into the picture, they restricted women to own any property. Women were not allowed to buy any property, land or assets. Hence, men started owning all the “Gifts” given to the bride by her parents.

This rule changed pure dowry system into a mess! Now parents of the bride were looking at their bride as a source of income. Parents started hating their daughters and wanted only sons. They started demanding money as a dowry. Women were suppressed since they did not have equal rights as men. And since then, grooms parents follow this rule to their advantage.

Why the Dowry System Should be Stopped?

The new dowry system is creating problems in society. Poor parents do not get any groom who will marry their daughter without taking dowry. They have to take “Marriage Loans” to get their daughter married.

Dowry is becoming a nightmare for Women. The cases of infanticide are increasing. Poor parents do not have any other option. They cannot afford to have a girl child, and hence they are intentionally killing infant girl. More than 8000 women are killed because of Dowry!

It is very clear that Dowry is creating violence. Groom’s parents are misusing this pure tradition. And they are not aware that they are misusing it, because they are not educated about the traditional dowry system. Everyone is just following the new dowry system blindly.

Dowry is complete injustice with women and does not give women equal status in society. Because of dowry men will always be superior to women. This is creating a mess and negative environment in society.

Under the Dowry Prohibition Act, taking or giving dowry is a crime and illegal . If you see someone taking or giving dowry then you can lodge a complaint against them.

Dowry system is good unless and until it is considered as a gift given to the bride by her parents. If the groom’s parents are demanding money to get married as a “ Dowry ” then that is completely wrong and illegal.

The dowry system in India is a long-standing practice and is deeply rooted in Indian culture. It is a pre-arranged agreement between two families and is usually decided at the time of marriage. The bride’s family provides the groom’s family with various gifts and money. These gifts usually include jewellery, clothes, and cash. Although this system is widely accepted, it has many negative impacts. The most serious consequence is that it leads to gender discrimination. In some cases, the dowry demands from the groom’s family can be so high that it becomes impossible for the bride’s family to meet them. Dowry system is an age-old practice in India which refers to the transfer of property and money from the bride's family to the groom's family. This system is most popular in India and a few other countries. Growing up, most of us have seen or heard of this system. The bride's family suffers because of the dowry system. Many times, the marriage is abruptly called off if the groom’s side's demands for dowry are not met. Furthermore, this system also puts a lot of pressure on the bride’s family, especially on the bride’s father. He is expected to provide the groom’s family with all the gifts and money. This can be a huge financial burden and can lead to the family’s financial instability.

The Indian government act of 1961 forbids individuals from accepting dowry as part of the government's effort to put an end to this abhorrent social practice.

Negative Impact Of Dowry System

Injustice | For the bride's family, the dowry carries a significant financial burden. A girl child is therefore seen as a potential burden and potential financial drain on the family. This viewpoint takes form of female infanticides and foeticides. Girls are frequently marginalised in areas of schooling where boys of the family are given preference. They are subjected to a number of limitations and forced to remain indoors in the name of maintaining family honour. Age is still seen as a measure of purity, which leads to the continued practice of child marriages. The practice is supported by the fact that the amount of dowry rises with the girl's age.

Violence Against Women | Contrary to popular belief, dowry is not always a one-time payment. The husband's family, who sees the girl's family as an endless supply of money, is always making demands. The girl's family's inability to meet further demands often results in verbal abuse, interpersonal violence, and even fatalities. Women endure constant physical and psychological abuse and therefore more at risk of experiencing depression and even attempt suicide.

Financial Burden | Due to the dowry demands made by the groom's family, Indian parents often associate getting a girl married with a substantial sum of money. Families frequently take on large amounts of debt and mortgage homes, which significantly harms their economic health.

Gender Inequality | The notion of paying dowry in order to marry a girl increases the sense of disparity between the sexes, elevating males above women. Young girls are barred from attending school while their brothers are allowed to attend. They are frequently discouraged from taking on occupations since they are seen as unfit for jobs other than household duties. Most of the time, their opinions are silenced, ignored, or treated with disrespect.

To combat the unjust practise of dowry, India as a nation needs to drastically alter its current mindsets. They must understand that in today's world, women are perfectly capable of performing any task that males are capable of. Women themselves must abandon the notion that they are subordinate to men and must rely on them to take care of them.

The Dowry system in India has been running for a long time. It is the money that is given during marriage to the boy or their family, even property can also be included in dowry. The system of dowry started in ancient times during marriage the money will be given to the groom so that he can take proper care of his bride, it was used to honor both sides of the family. As time changes dowry still remains in society but its significance keeps changing with time. 

Nowadays, the dowry system is becoming like a business for some castes. The Dowry system is becoming a burden for the bride’s family. Many times if demand is not fulfilled for the boy's side then the marriage is abruptly canceled as a result of this failure.  If we see it in our Asian country, then dowry is becoming more important for the groom's side, mainly in countries like India.  To end this heinous social practice, the government has made a law to refrain people from taking dowry under the Act of 1961. 

Whatever money or property given by the bride side they should accept but it never followed. In many places, we come to know that because of not doing so on the groom's side the girls are harmed in such a way that sometimes even it leads to death. Some people even think dowry is like crime, it's illegal and they never ask anything from the bride's family. 

In India, everyone speaks and progresses for women's rights and says ‘Beti Bachao Beti Padhao’ but a girl even after achieving everything in her life; where starts taking care of her family but even then she can't escape the shackles of dowry. Sometimes because of dowry which is mostly prevalent among the below poverty line people, they kill their daughters after they are born or before their birth in the mother’s womb itself so that they can escape dowry. Since they know after growing up and educating her, they still need to give dowry in order to get her married. However, one fails to understand that it is not a daughter’s fault for which she is being wrongfully punished but the fault of the society that allows such practices even after so many years of independence. 

The History of Dowry 

The dowry system predates the British period and colonization in India. In those days, dowry was not considered "money" or a "fee" that the Bride's parents had to pay.  One of the fundamental purposes of dowry was it acted as a form of protection for the wife against the ill-treatment by her husband and his family. Dowry also served as a helping hand for the bride and the groom to build a life together after marriage. 

When British authority came into effect, however, women were barred from owning any property. Women were not permitted to purchase any real estate, land, or assets. As a result, males began to possess all of the "Gifts" provided to the Bride by her parents. 

During the British Raj, the dowry system was made mandatory leading to immense pressure on the bride’s family financially. Dowry violence has become a prominent aspect that can be observed till date. The husband or his family use violence as a method to extract money from the bride’s family as a “gift.” This system leads to women being dependent on their husbands or in-laws after their marriage.

What are the Effects of the Dowry System?

Gender Stereotyping: Women are frequently viewed as liabilities due to the dowry system. They are frequently subjected to subordination and second-class treatment in terms of education and other amenities. 

Affecting a Women's Career: The lack of women in labour, and thus their lack of financial independence, is the greater context for the practice of dowry. The poorer sectors of society send their daughters out to work to help them save money for their dowry.  While most middle and upper-class families send their girls to school, they do not prioritize job opportunities. 

Objectifying Women: Today's dowry is more equivalent to a financial investment by the Bride's family to get access to powerful connections and lucrative business possibilities. As a result, women are reduced to commodities. 

Crime Against Women: Domestic violence includes the violence and murders related to dowry demands. Physical, mental, economic violence, and harassment as a way of enforcing compliance or punishing the victim are all utilized in dowry-related offenses, similar to domestic violence.

How to tackle the Social Evil of Dowry?

The dowry system is a social taboo that must be abolished. Every girl should be proud to visit her in-laws. In India, the dowry system affects 5 out of 10 families. Although the government has enacted numerous regulations, the practice of dowry continues to exist in our society. As a result, we all must begin taking action to combat it. Starting from our own homes is the first step. At home, both boys and girls should be treated similarly and given equal opportunity. Both of them should be educated and given the freedom to be completely self-sufficient. Education and freedom are the two most powerful and valuable gifts that parents can give to their daughters. Only education will allow her to be financially secure and a valuable family member, earning her respect and suitable family standing. As a result, the best dowry a father can bestow on his daughter is an excellent education, guidance, and motivation to pursue her aspirations. 

Another thing that needs to be done is make suitable legal amends.  No one can implement a law without the people's full cooperation. Enacting a law, without a doubt, establishes a pattern of behavior, engages social conscience, and aids social reformers in their efforts to repeal it. The system must give more moral value-based education to the common people to extend their brains and perspectives. 

Society should strive for gender equality. Protection of Women from Domestic Violence Act, 2005

Lack of education is one of the main contributors to social practices such as dowry system, caste system and child labour. People must be educated to promote logical and reasonable thinking to get rid of belief systems that give rise to such evil practices.

• Empowering Women

Instead of looking for a well-settled groom for their daughters and investing all their savings in the wedding, people must spend on the latter’s education and make her self-dependent. Women must continue to work even after their marriage and focus their energy on productive things rather than succumbing to the sarcastic remarks of in-laws. Women must also be made aware of their rights and how they can use them to guard themselves from any kind of abuse.

• Gender Equality

Gender inequality that exists at the core of our society is one of the main reasons for dowry system. From a very early age, children must be taught how both males and females have equal rights and are not superior/ inferior to each other.

Apart from this campaigns should be held to sensitize the issue and the laws set by the government must be made more stringent.

The intentions then were made clear, and so the bride’s parents used to provide assets, land, or money to the bride as a “Gift” to ensure that their daughter will be independent and happy after marriage. 

However, when Britishers came, they restricted women from owning any property and could not buy assets, land, or any property. Therefore, men owned all the gifts given to the bride by her parents. 

This rule changed the pure dowry system into a mess. These days bride’s parents are seeking their bride as a source of income. Parents hated their daughters and want only sons, and they demanded money as a dowry.

India, as a country, needs a significant overhaul of its existing mindsets to push back against the evil custom of dowry system. They must realize the fact that in today’s social environment , women can do anything that men can.

Women themselves must come out of the belief that they are inferior to men and must depend on men to provide for them.

Instead of looking for a well-settled groom for their daughters and investing all their savings in the wedding, people must spend on the latter’s education and make her self-dependent. Women must continue to work even after their marriage and focus their energy on productive things rather than succumbing to the sarcastic remarks of in-laws. Women must also be made aware of their rights and how they can use them to guard themselves from any kind of abuse.

Apart from this campaigns should be held to sensitize the issue and the laws set by the government must be made more stringent.

Dowry system is the cause of agony for the girl and her family. The solutions mentioned here must be taken seriously and incorporated in the system to get rid of this problem. The government and general public must join hands to eradicate this system.

Similarly, an uneducated individual doesn’t know much about society. Some people are also conservative-minded and this is one of the major problems in the context of Nepal. Such a conservative mindset is due to their blind faith in religion and completely unreasonable facts. Although slowly being erased in urban areas, problems such as discrimination on the basis of caste, gender, skin, and color are very common in rural areas of Nepal. They give rise to social evils that hamper the lives of many people. Out of such social evils, the Dowry system is one of them.

The Dowry system was prevalent in many parts of Nepal but has slowly stopped in some regions. Dowry system is generally seen in the Terai regions of Nepal with some cases even in the Hill region. In a marriage, dowry is a process of giving some amount of wealth to the bride groom’s family by the bride’s family. In other words, a dowry is the transfer of parental property or wealth upon the marriage of a daughter by their family. Although it started fairly innocent and worked as a token of love and support, the situation has gotten out of hand. From an innocent gift, Dowry has become a compulsion to many groom families and the choice of what to ask for is up to them too. It no more is a token of love but a requirement to fulfill the greedy demands. If such conditions are not fulfilled, it may even lead to the death of the bride.

Dowry has been given such priority that it is kept above marriage for love and starting a family and the groom’s family asking for properties. Properties may include cash, electronics, vehicles, houses, or even lands. If the conditions of Dowry aren’t fulfilled then the life of the bride becomes very hard. They are tortured and mentally bullied having not given the dowry. Nothing breaks a parent’s heart than to watch their own daughter being tortured due to dowry requirements not being fulfilled. In some cases, brides have even committed suicide to avoid such torture or give misery to their parents.

People have gone bankrupt trying to fulfill the conditions, faced other mental problems, and aren’t happy at all. The Dowry system is a totally unwanted evil in our society. A person will give their best as a token of love but not expect anything in return. There’s no greater gift and sacrifice from the bride’s family to give their own daughter to someone else. It should be a great pride and joy to be married but the prevalence of the Dowry system makes females seem like tools and unwanted. The groom’s family would simply search for another bride who can fulfill their dowry requests.

This is why reforms are needed in Nepal’s system. Not only Nepal, dowry systems are prevalent even in abroad countries such as India or other South Asian countries. The Dowry system will just lead to more discrimination and violence in the name of wealth. Women’s rights are being seriously violated, parents of the bride’s family have to suffer huge losses making girls unwanted in society. But they don’t realize the importance of women.

This is why women’s empowerment is necessary. It can only be established by awareness programs, rallies, enforcing strict rules and regulations against women violence, and banning dowry altogether. If found, the groom’s family should compensate the bride’s family or even serve a prison sentence. Enforcing strict rules seems to be an effective way as people fear their loss of respect and prestige. Money is given emphasis over the emotional bonding in today’s world. This is totally due to the greed people have and there is nothing greater than the emotional belonging of a person. People have to realize that and look through the shoes of the parents who have to pay a heavy dowry to just bid their daughters farewell. Eradication of the Dowry system is a necessity to protect women, their parents and get rid of conservative people’s mindsets. Greediness also plays a role in such decisions but people need to know that only if we eradicate discrimination and other gender barriers we can come together and contribute to the development of society.

Anupam Mittal Launches 'Dowry Calculator' On Shaadi.com. It Is Not What You Think

Users expected it to estimate dowry amounts based on education and financial status but found it presented statistics on dowry deaths in the past decade.

Shark Tank India judge, Anupam Mittal, faced online criticism after Shaadi.com launched a Dowry Calculator. Many accused him of “promoting” the illegal tradition. Despite the backlash, Mittal gained more attention as he shared a video on how to use the controversial feature. He didn’t disclose its true purpose. Users expected it to estimate dowry amounts based on education and financial status but found it presented statistics on dowry deaths in the past decade. While some praised Mittal for raising awareness, the majority criticised him for seemingly endorsing dowry practices.

In the video, Anupam Mittal said, “Calculating dowry used to be so easy in the past with just a few questions, do you have a car, a bungalow, a bank balance? But nowadays, it’s become very complicated. Do you have income or SIP, startup equity or not, do you use Android or iPhone, are you woke or not, Maldives or Lakshadweep for the honeymoon, BJP or Congress? The questions never end. So we thought, why not simplify this? We’ve combined AI, ML and ChatGPT to create a dowry calculator, which we call DowrAI.” Sharing the clip, the CEO wrote, “Ek chutki sindoor ki keemat ab tum bhi jaano Ramesh babu.”

Reacting to the clip, a user said, “People hating without actually visiting the site. It’s a campaign against dowry, it shows the number of deaths due to dowry.”

Another jokingly suggested, “Ek alimony calculator bhi bana do.”

“Amazing initiative,” a comment read.

An individual shared, “Those who didn’t understand, it’s a Sarcasm bro.”

“Very catchy marketing to bring about change,” someone wrote.

Applauding the initiative, a user mentioned, “I salute you man. The way you find to open the eyes of the people is really formidable. Keep doing great things. You have a lot of blessings of many families from India.”

Interestingly, the initiative is not new, as Anupam Mittal led Shaadi.com introduced the same feature back in 2015, in partnership with NGO Stree Mukti Sanghatana.

Jamie Raskin: How to Force Justices Alito and Thomas to Recuse Themselves in the Jan. 6 Cases

Many people have gloomily accepted the conventional wisdom that because there is no binding Supreme Court ethics code, there is no way to force Associate Justices Samuel Alito and Clarence Thomas to recuse themselves from the Jan. 6 cases that are before the court.

Justices Alito and Thomas are probably making the same assumption.

But all of them are wrong.

It seems unfathomable that the two justices could get away with deciding for themselves whether they can be impartial in ruling on cases affecting Donald Trump’s liability for crimes he is accused of committing on Jan. 6. Justice Thomas’s wife, Ginni Thomas, was deeply involved in the Jan. 6 “stop the steal” movement. Above the Virginia home of Justice Alito and his wife, Martha-Ann Alito, flew an upside-down American flag — a strong political statement among the people who stormed the Capitol. Above the Alitos’ beach home in New Jersey flew another flag that has been adopted by groups opposed to President Biden.

Justices Alito and Thomas face a groundswell of appeals beseeching them not to participate in Trump v. United States , the case that will decide whether Mr. Trump enjoys absolute immunity from criminal prosecution, and Fischer v. United States , which will decide whether Jan. 6 insurrectionists — and Mr. Trump — can be charged under a statute that criminalizes “corruptly” obstructing an official proceeding. (Justice Alito said on Wednesday that he would not recuse himself from Jan. 6-related cases.)

Everyone assumes that nothing can be done about the recusal situation because the highest court in the land has the lowest ethical standards — no binding ethics code or process outside of personal reflection. Each justice decides for him- or herself whether he or she can be impartial.

Of course, Justices Alito and Thomas could choose to recuse themselves — wouldn’t that be nice? But begging them to do the right thing misses a far more effective course of action.

The U.S. Department of Justice — including the U.S. attorney for the District of Columbia, an appointed U.S. special counsel and the solicitor general, all of whom were involved in different ways in the criminal prosecutions underlying these cases and are opposing Mr. Trump’s constitutional and statutory claims — can petition the other seven justices to require Justices Alito and Thomas to recuse themselves not as a matter of grace but as a matter of law.

The Justice Department and Attorney General Merrick Garland can invoke two powerful textual authorities for this motion: the Constitution of the United States, specifically the due process clause, and the federal statute mandating judicial disqualification for questionable impartiality, 28 U.S.C. Section 455. The Constitution has come into play in several recent Supreme Court decisions striking down rulings by stubborn judges in lower courts whose political impartiality has been reasonably questioned but who threw caution to the wind to hear a case anyway. This statute requires potentially biased judges throughout the federal system to recuse themselves at the start of the process to avoid judicial unfairness and embarrassing controversies and reversals.

The constitutional and statutory standards apply to Supreme Court justices. The Constitution, and the federal laws under it, is the “ supreme law of the land ,” and the recusal statute explicitly treats Supreme Court justices as it does other judges: “Any justice, judge or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.” The only justices in the federal judiciary are the ones on the Supreme Court.

This recusal statute, if triggered, is not a friendly suggestion. It is Congress’s command, binding on the justices, just as the due process clause is. The Supreme Court cannot disregard this law just because it directly affects one or two of its justices. Ignoring it would trespass on the constitutional separation of powers because the justices would essentially be saying that they have the power to override a congressional command.

When the arguments are properly before the court, Chief Justice John Roberts and Associate Justices Amy Coney Barrett, Neil Gorsuch, Ketanji Brown Jackson, Elena Kagan, Brett Kavanaugh and Sonia Sotomayor will have both a constitutional obligation and a statutory obligation to enforce recusal standards.

Indeed, there is even a compelling argument based on case law that Chief Justice Roberts and the other unaffected justices should raise the matter of recusal on their own, or sua sponte. Numerous circuit courts have agreed with the Eighth Circuit that this is the right course of action when members of an appellate court are aware of “ overt acts ” of a judge reflecting personal bias. Cases like this stand for the idea that appellate jurists who see something should say something instead of placing all the burden on parties in a case who would have to risk angering a judge by bringing up the awkward matter of potential bias and favoritism on the bench.

But even if no member of the court raises the issue of recusal, the urgent need to deal with it persists. Once it is raised, the court would almost surely have to find that the due process clause and Section 455 compel Justices Alito and Thomas to recuse themselves. To arrive at that substantive conclusion, the justices need only read their court’s own recusal decisions.

In one key 5-to-3 Supreme Court case from 2016, Williams v. Pennsylvania, Justice Anthony Kennedy explained why judicial bias is a defect of constitutional magnitude and offered specific objective standards for identifying it. Significantly, Justices Alito and Thomas dissented from the majority’s ruling.

The case concerned the bias of the chief justice of Pennsylvania, who had been involved as a prosecutor on the state’s side in an appellate death penalty case that was before him. Justice Kennedy found that the judge’s refusal to recuse himself when asked to do so violated due process. Justice Kennedy’s authoritative opinion on recusal illuminates three critical aspects of the current controversy.

First, Justice Kennedy found that the standard for recusal must be objective because it is impossible to rely on the affected judge’s introspection and subjective interpretations. The court’s objective standard requires recusal when the likelihood of bias on the part of the judge “is too high to be constitutionally tolerable,” citing an earlier case. “This objective risk of bias,” according to Justice Kennedy, “is reflected in the due process maxim that ‘no man can be a judge in his own case.’” A judge or justice can be convinced of his or her own impartiality but also completely missing what other people are seeing.

Second, the Williams majority endorsed the American Bar Association’s Model Code of Judicial Conduct as an appropriate articulation of the Madisonian standard that “no man can be a judge in his own cause.” Model Code Rule 2.11 on judicial disqualification says that a judge “shall disqualify himself or herself in any proceeding in which the judge’s impartiality might reasonably be questioned.” This includes, illustratively, cases in which the judge “has a personal bias or prejudice concerning a party,” a married judge knows that “the judge’s spouse” is “a person who has more than a de minimis interest that could be substantially affected by the proceeding” or the judge “has made a public statement, other than in a court proceeding, judicial decision or opinion, that commits or appears to commit the judge to reach a particular result.” These model code illustrations ring a lot of bells at this moment.

Third and most important, Justice Kennedy found for the court that the failure of an objectively biased judge to recuse him- or herself is not “harmless error” just because the biased judge’s vote is not apparently determinative in the vote of a panel of judges. A biased judge contaminates the proceeding not just by the casting and tabulation of his or her own vote but by participating in the body’s collective deliberations and affecting, even subtly, other judges’ perceptions of the case.

Justice Kennedy was emphatic on this point : “It does not matter whether the disqualified judge’s vote was necessary to the disposition of the case. The fact that the interested judge’s vote was not dispositive may mean only that the judge was successful in persuading most members of the court to accept his or her position — an outcome that does not lessen the unfairness to the affected party.”

Courts generally have found that any reasonable doubts about a judge’s partiality must be resolved in favor of recusal. A judge “shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.” While recognizing that the “challenged judge enjoys a margin of discretion,” the courts have repeatedly held that “doubts ordinarily ought to be resolved in favor of recusal.” After all, the reputation of the whole tribunal and public confidence in the judiciary are both on the line.

Judge David Tatel of the D.C. Circuit emphasized this fundamental principle in 2019 when his court issued a writ of mandamus to force recusal of a military judge who blithely ignored at least the appearance of a glaring conflict of interest. He stated : “Impartial adjudicators are the cornerstone of any system of justice worthy of the label. And because ‘deference to the judgments and rulings of courts depends upon public confidence in the integrity and independence of judges,’ jurists must avoid even the appearance of partiality.” He reminded us that to perform its high function in the best way, as Justice Felix Frankfurter stated, “justice must satisfy the appearance of justice.”

The Supreme Court has been especially disposed to favor recusal when partisan politics appear to be a prejudicial factor even when the judge’s impartiality has not been questioned. In Caperton v. A.T. Massey Coal Co. , from 2009, the court held that a state supreme court justice was constitutionally disqualified from a case in which the president of a corporation appearing before him had helped to get him elected by spending $3 million promoting his campaign. The court, through Justice Kennedy, asked whether, quoting a 1975 decision, “under a realistic appraisal of psychological tendencies and human weakness,” the judge’s obvious political alignment with a party in a case “poses such a risk of actual bias or prejudgment that the practice must be forbidden if the guarantee of due process is to be adequately implemented.”

The federal statute on disqualification, Section 455(b) , also makes recusal analysis directly applicable to bias imputed to a spouse’s interest in the case. Ms. Thomas and Mrs. Alito (who, according to Justice Alito, is the one who put up the inverted flag outside their home) meet this standard. A judge must recuse him- or herself when a spouse “is known by the judge to have an interest in a case that could be substantially affected by the outcome of the proceeding.”

At his Senate confirmation hearing, Chief Justice Roberts assured America that “judges are like umpires.”

But professional baseball would never allow an umpire to continue to officiate the World Series after learning that the pennant of one of the two teams competing was flying in the front yard of the umpire’s home. Nor would an umpire be allowed to call balls and strikes in a World Series game after the umpire’s wife tried to get the official score of a prior game in the series overthrown and canceled out to benefit the losing team. If judges are like umpires, then they should be treated like umpires, not team owners, fans or players.

Justice Barrett has said she wants to convince people “that this court is not comprised of a bunch of partisan hacks.” Justice Alito himself declared the importance of judicial objectivity in his opinion for the majority in the Dobbs v. Jackson Women’s Health Organization decision overruling Roe v. Wade — a bit of self-praise that now rings especially hollow.

But the Constitution and Congress’s recusal statute provide the objective framework of analysis and remedy for cases of judicial bias that are apparent to the world, even if they may be invisible to the judges involved. This is not really optional for the justices.

I look forward to seeing seven members of the court act to defend the reputation and integrity of the institution.
