What the New Overtime Rule Means for Workers

One of the basic principles of the American workplace is that a hard day’s work deserves a fair day’s pay. Simply put, every worker’s time has value. A cornerstone of that promise is the  Fair Labor Standards Act ’s (FLSA) requirement that when most workers work more than 40 hours in a week, they get paid more. The  Department of Labor ’s new overtime regulation is restoring and extending this promise for millions more lower-paid salaried workers in the U.S.

Overtime protections have been a critical part of the FLSA since 1938 and were established to protect workers from exploitation and to benefit workers, their families and our communities. Strong overtime protections help build America’s middle class and ensure that workers are not overworked and underpaid.

Some workers are specifically exempt from the FLSA’s minimum wage and overtime protections, including bona fide executive, administrative or professional employees. This exemption, typically referred to as the “EAP” exemption, applies when: 

1. An employee is paid a salary,  

2. The salary is not less than a minimum salary threshold amount, and 

3. The employee primarily performs executive, administrative or professional duties.

While the department increased the minimum salary required for the EAP exemption from overtime pay every 5 to 9 years between 1938 and 1975, long periods between increases to the salary requirement after 1975 have caused an erosion of the real value of the salary threshold, lessening its effectiveness in helping to identify exempt EAP employees.

The department’s new overtime rule was developed based on almost 30 listening sessions across the country and the final rule was issued after reviewing over 33,000 written comments. We heard from a wide variety of members of the public who shared valuable insights to help us develop this Administration’s overtime rule, including from workers who told us: “I would love the opportunity to...be compensated for time worked beyond 40 hours, or alternately be given a raise,” and “I make around $40,000 a year and most week[s] work well over 40 hours (likely in the 45-50 range). This rule change would benefit me greatly and ensure that my time is paid for!” and “Please, I would love to be paid for the extra hours I work!”

The department’s final rule, which will go into effect on July 1, 2024, will increase the standard salary level that helps define and delimit which salaried workers are entitled to overtime pay protections under the FLSA. 

Starting July 1, most salaried workers who earn less than $844 per week will become eligible for overtime pay under the final rule. And on Jan. 1, 2025, most salaried workers who make less than $1,128 per week will become eligible for overtime pay. As these changes occur, job duties will continue to determine overtime exemption status for most salaried employees.

Who will become eligible for overtime pay under the final rule? Currently most salaried workers earning less than $684/week. Starting July 1, 2024, most salaried workers earning less than $844/week. Starting Jan. 1, 2025, most salaried workers earning less than $1,128/week. Starting July 1, 2027, the eligibility thresholds will be updated every three years, based on current wage data. The rule will also increase the total annual compensation requirement for highly compensated employees (who are not entitled to overtime pay under the FLSA if certain requirements are met) from $107,432 per year to $132,964 per year on July 1, 2024, and then set it equal to $151,164 per year on Jan. 1, 2025.

Starting July 1, 2027, these earnings thresholds will be updated every three years so they keep pace with changes in worker salaries, ensuring that employers can adapt more easily because they’ll know when salary updates will happen and how they’ll be calculated.

The final rule will restore and extend the right to overtime pay to many salaried workers, including workers who historically were entitled to overtime pay under the FLSA because of their lower pay or the type of work they performed.

As the speaker of the House finally allows a vote to go forward on aid, GOP infighting is tearing apart the party

Republican divisions over military support for Ukraine were long simmering. Now, before Saturday’s extraordinary vote in Congress on a foreign aid package, they have erupted into open warfare – a conflict that the vote itself is unlikely to contain.

Mike Johnson, the speaker of the House of Representatives , triggered an all-out split in his own party’s ranks last week by finally agreeing, after months of stalling, to a floor vote on the $95bn foreign aid programme. Passed by the Senate in February, it contained about $60bn for Ukraine, $14bn for Israel, and a smaller amount for Taiwan and other Pacific allies.

Johnson’s decision to finally bring the package to a vote made a highly symbolic break with the GOP’s far right, the people who engineered his elevation to the speaker’s chair last October after toppling his predecessor, Kevin McCarthy. These Republican rightwingers – reflecting the affinity of their political idol, the former president Donald Trump, for the Russian president, Vladimir Putin – have grown openly hostile to Ukraine’s cause.

Speaking from the Capitol on Thursday, Johnson made no apologies for antagonising them, telling C-SPAN that providing aid to Ukraine was “critically important” and “the right thing” despite the potential power of his opponents to bring him down in yet another internal party coup.

“I really believe the intel and the briefings that we’ve gotten,” Johnson said. “I believe that Xi and Vladimir Putin and Iran really are an axis of evil. I think they are in coordination on this. I think that Vladimir Putin would continue to march through Europe .

“I am going to allow an opportunity for every single member of the House to vote their conscience and their will,” he said, adding: “I’m willing to take a personal risk for that, because we have to do the right thing. And history will judge us.”

The backlash was fierce. Marjorie Taylor Greene , the outspoken Georgia representative, immediately filed a resolution demanding Johnson’s removal, called the bill a “sham”.

“I don’t care if the speaker’s office becomes a revolving door,” Taylor Greene told Steve Bannon, Trump’s former adviser, on his War Room channel. “The days are over of the old Republican party that wants to fund foreign wars and murder people in foreign lands while they stab the American people in their face and refuse to protect Americans and fix our problems.”

Branded “Moscow Marjorie” by former Republican representative Ken Buck, who said she gets her talking points from the Kremlin, Taylor Greene went further by accusing Ukraine of waging “a war against Christianity”.

“The Ukrainian government is attacking Christians, the Ukrainian government is executing priests,” she said. “Russia is not doing that. They’re not attacking Christianity.” (In fact, according to figures from the Institute for Religious Freedom , a Ukrainian group, at least 630 religious sites had been damaged or looted in Russia’s invasion by December last year.)

Taylor Greene’s move to oust Johnson was supported by the Kentucky representative Thomas Massie, who also backed an ultimately successful attempt to remove a previous Republican speaker, John Boehner, nearly a decade ago.

Other Republican rightwingers are unhappy, too, though they have so far stopped short of moving to topple the speaker. That might be because Trump, the party’s presumptive nominee for president who is currently on trial on fraud charges relating to paying hush money to keep American voters from learning about his alleged affair with an adult film star, has backed Johnson.

So have all four Republican chairs of the key House committees – foreign affairs, intelligence, armed services and appropriations - a position driven by the sheer urgency of Ukraine’s predicament.

More than two years into the war, Ukraine has a catalogue of absolutely critical military requirements , including artillery shells, air defence missiles and deep-strike rockets.

Johnson has tried to dilute the internal opposition by unbundling the aid package into four separate bills, with each to be voted on individually – apparently in the hope that the chance to vote against the bits they dislike (such as Ukraine) while backing causes more palatable to them (such as Israel) will placate the implacable.

Although the Republicans’ house majority is now whittled down to two, Democrats – who mostly back funding Ukraine’s defense against the Russian invasion – have pledged to support Johnson’s bills. That could mean Ukraine would finally get the US assistance it has so fervently hoped for: roughly $60bn in assistance (much of which would be to replenish weapons stocks provided by the US), including $10bn to be given in the form of a loan, a concept Trump has apparently endorsed.

Predictably, Democrats are gloating. Jared Moskowitz, a Democratic representative from Florida, moved an amendment to the Ukraine bill calling for Taylor Greene’s office in the Cannon building to be renamed the Neville Chamberlain room – in homage to the pre-second world war British prime minister notorious for appeasing Hitler – and asking she be appointed “Vladimir Putin’s special envoy to the US”.

While Saturday’s vote may settle the Ukraine issue for now, Republican divisions will probably rumble on, according to Kyle Kondik of the Center for Politics at the University of Virginia.

“The GOP split on Ukraine would remain, but the need for action (or inaction) in the short term would be solved,” he said.

“Johnson may be well-positioned to survive as speaker because Democrats may provide him some votes. But the GOP conference is so divided (and so small in its majority) that I’m sure something else will come along to cause more turbulence.”

A bitcoin halving is imminent. Here's what that means.

Bitcoin is expected to go through a "halving" within the next day or two, a preprogrammed event that could impact production of the world's largest cryptocurrency. 

A halving, which occurs about every four years, was designed by bitcoin's creator,  Satoshi Nakamoto , to effectively reduce by half the reward that miners of the digital token receive. The idea is that by cutting in half the amount bitcoin miners currently make for their efforts, fewer bitcoins will enter the market, creating more scarcity of the cryptocurrency.

That's sparked some speculation that the halving could cause a surge in demand and push up the price of bitcoin, which has already risen almost 50% since year start. Much of the credit for bitcoin's recent rally is given to the early success of a new way to invest in the asset —  spot bitcoin ETFs, which were only approved by U.S. regulators in January. 

Here's what to know about bitcoin's "halving."

What exactly is bitcoin "halving"?

Bitcoin miners get a fixed reward when they successfully validate a new block on the bitcoin blockchain. That reward is currently 6.25 bitcoin, worth about $402,000, based on today's trading price for the token. 

After the halving, miners will receive 3.125 bitcoin for achieving the same goal. As a result, the rate at which new bitcoins enter the market should also fall, slowing the supply of coins. According to limits set by Satoshi Nakamoto, only a maximum of 21 million bitcoins will ever exist, of which more than 19.5 million have already been mined, leaving fewer than 1.5 million left to be created.

When was the last bitcoin halving?

The last such event happened in May 2020, when bitcoin's price stood at around $8,602, according to CoinMarketCap. 

By May 2021, the value of bitcoin had surged almost seven-fold to almost $57,000. 

When will the next halving occur? 

Halving is scheduled to occur regularly after the creation of every 210,000 "blocks" — where transactions are recorded — during the mining process, that are added to the blockchain.

While there aren't any set calendar dates for this to occur, it generally works out to roughly once every four years. The latest estimates expect the next halving to occur sometime late Friday or early Saturday.

What do expert say could happen with bitcoin's price after the next halving?

Some believe that it will be a non-event for bitcoin's price because the cryptocurrency has already experienced a big run-up this year.

"Investors, traders and speculators priced-in the halving months ago," said Nigel Green, the CEO of financial services firm deVere Group, in an email. "As a result, a significant portion of the positive economic impact was experienced previously, driving up prices to fresh all-time highs last month."

Still, others say that bitcoin could get a bump, at least longer-term. Growing demand due to the new ETFs, combined with the supply shock of the next halving, could help push bitcoin's price even higher, said Bitwise senior crypto research analyst Ryan Rasmussen.

"We would expect the price of bitcoin to have a strong performance over the next 12 months," he said. Rasmussen notes that he's seen some predict gains reaching as high as $400,000, but the more "consensus estimate" is closer to the $100,000-$175,000 range.

What is the halving's impact on bitcoin miners?

Miners will likely be pressed to become more energy efficient, or may need to raise new capital, experts said. 

In its recent research report, Bitwise found that total miner revenue slumped one month after each of the three previous halvings. But those figures had rebounded significantly after a full year, thanks to spikes in the price of bitcoin as well as larger miners expanding their operations.

Time will tell how mining companies fare following this next looming halving. But Rasmussen is betting that big players will continue to expand and utilize the industry's technology advances to make operations more efficient.

F.T.C. Issues Ban on Worker Noncompete Clauses

The rule would prohibit companies from limiting their employees’ ability to work for rivals, a change that could increase competition and boost wages.

The Federal Trade Commission on Tuesday said employers could no longer, in most cases, stop their employees from going to work for rival companies.

The sweeping action could help create jobs, raise wages and increase competition among businesses, the agency said. But the action is all but certain to be challenged in court by businesses that say they need to protect trade secrets and confidential information.

The move bars contracts known as noncompetes, which prevent workers from leaving for a competitor for a certain amount of time, in most circumstances. Noncompetes cover about 30 million U.S. workers, the trade commission said, in a variety of jobs that include TV news producers , hairdressers, corporate executives and computer engineers.

The commission has said the proposal would raise wages by forcing companies to compete harder for talent. It was approved in a 3-to-2 vote. Commissioners Melissa Holyoak and Andrew N. Ferguson, both Republicans, voted against the measure.

“The F.T.C.’s final rule to ban noncompetes will ensure Americans have the freedom to pursue a new job, start a new business or bring a new idea to market,” the commission’s chair, Lina M. Khan, said in a statement. She estimated the decision would lead to the creation of 8,500 start-ups in a year and up to $488 billion in increased wages for workers over the next decade.

President Biden celebrated the F.T.C.’s vote in a social media post . “Workers ought to have the right to choose who they want to work for,” he wrote on X.

But the U.S. Chamber of Commerce vowed to sue the F.T.C. to block the proposal, calling it “an unlawful power grab” in a statement shortly after the vote. The chamber, as well as the two dissenting commissioners, has argued that the F.T.C. doesn’t have the authority to address this issue and that it should be left to the states.

The agency voted more than a year after it first issued the proposed rule, in January 2023. It said it had received more than 20,000 comments from the public about the rule.

Employers have argued that noncompete contracts provide an incentive to invest in employees — because they ensure that the worker won’t leave to join a competitor. Unions, including the A.F.L.-C.I.O. and the Service Employees International Union, have supported the F.T.C.’s move.

The rule would become law 120 days after it is published in the Federal Register, which will probably happen in a few days. But legal challenges could delay or block the change.

Noncompete contracts affecting senior executives can remain in effect, the commission said, but employers are barred from trying to impose new noncompetes on any employee, including executives.

The new rule defines executives as employees “in policy-making positions” who make at least $151,164 annually. It orders employers to notify nonexecutive employees bound by an existing noncompete that it will no longer be enforceable.

Some states, including California and Oregon, have moved to restrict noncompetes on their own.

In December, Gov. Kathy Hochul of New York vetoed a bill that would have banned noncompetes in the state. She said the bill should have been narrower and apply only to low-wage workers. Wall Street staunchly opposed the legislation, which the State Legislature’s Democratic majority passed.

Workers in finance and professional services are the most likely to have noncompete contracts, at a rate of nearly 20 percent . Studies have shown that noncompetes suppress wages because switching jobs is the most efficient way workers can increase how much they make.

“This would be an immediate shock that would allow millions of workers to be free to take a better job in their industry,” said Evan Starr, an economics professor at the University of Maryland. “I would expect the labor market to increase almost overnight.”

Stefanie Camfield, an assistant general counsel at Engage PEO, a human resources consulting firm, said her clients had asked more about noncompetes in advance of the agency’s decision. While some of them use noncompetes to prevent workers from leaving for rival firms, she said, others struggle to hire workers bound by the same kind of agreements.

“We see the flip side of the coin as well,” Ms. Camfield said.

Joyce Smithey, a lawyer who represents workers in Maryland, said some of her clients had been pushed out of their industry because they worried about violating their noncompete contract. One, a female chief executive, left her industry to start a business out of fear of being sued by her deep-pocketed former employer.

“You sign these usually at the beginning of the relationship, when nobody is suspecting how bad it will become,” Ms. Smithey said.

Under Ms. Khan, the F.T.C. has taken a more aggressive stance toward regulating corporate America. It has tried to expand its role in proactively setting rules for businesses in addition to its work suing companies for legal violations. It has proposed new regulations to govern online and children’s privacy and ban hidden fees that are attached to consumer purchases.

In a separate action, the Department of Labor issued a final rule that will make millions more workers eligible for overtime pay. Workers making less than $58,656 will automatically be owed time and a half when the rule takes effect in January.
